A villager in Poy Char commune in Banteay Meanchay has accused local police of attempted extortion after he sold a Buddha statue he found on his property to a Thai national.

Tum Sandan, 49, yesterday said he unearthed the relic on July 21 and sold it to the man from Thailand for 70,000 Thai baht (about $2,000) and $100 cash. He said he did not know the buyer’s name.

Sandan said on July 24 the Phnom Srok district police chief, Yort Sophal, intimidated his wife into handing over most of the proceeds.

“Yort Sophal, the district police chief, accused me of illegally smuggling the ancient artefact,” Sandan said, adding that the officer told him his crime was the equivalent to treason. Sophal denied intimidating the couple, saying he had simply confiscated the money for evidence.

“This is illegal smuggling of an ancient statue,” Sophal said. “The money, we’ve already given to heritage police as evidence.”

… I hope that it is the government’s intention to have a free and fair election in 2017 and 2018. I think that if anyone has contrary intentions, there are certainly things that they can do that would be unfortunate but I think that they will find that, as we have seen in Burma and as we have seen in Sri Lanka and many countries over the last few years, it is very hard to deny people their voice and their choice.


By supporting Beijing on South China Sea matters at the recent ASEAN meeting in Laos and allegedly assassinating a harsh critic of his regime Kem Ley, it looks like Cambodian Prime Minister Hun Sen painted a bull’s eye on his own back.  But it will take a year or two to find out if his opponents can hit the mark.

At the ASEAN Foreign Ministers’ Conference in Laos on July 24, Cambodia’s intransigence on behalf of the PRC (China) in matters South China Sea was not as big an issue as it usually is.

The Philippine delegation of the new Duterte administration was apparently not very interested in provoking the PRC ahead of the upcoming bilateral discussions on the South China Sea, so the group eventually came together around a toothless communique that failed to invoke the UNCLOS arbitration ruling, thereby pleasing the PRC and advocates of ASEAN consensus, while evoking the scorn of China hawks in the region and around the world.

Yet, climate change and man-made pressures are affecting the lake, resulting in a drastic reduction in its fish stocks and worrying low water levels.

Earlier this year, the Global Nature Fund designated it as the world's most "threatened" for 2016.

"In recent years, the water volume continuously declined with negative impacts on fish migration and the import of sediments," GNF said in a statement.

As China’s fighter jets patrol the disputed South China Sea, a number of Southeast Asian nations are dragging their air force fleets into the 21st century


In the clear skies above China’s Hainan province in May, two Chinese J-11 fighter jets set upon a lone US military aircraft carrying out a reconnaissance mission off the island’s east coast. In a similar encounter two years earlier, a Chinese aircraft had bared its weapons at a separate encroaching jet in a naked display of hostility. This time, there was no need: surging forward to within 15 metres of the wayward plane, the pilots simply waited for the American to blink first.

Beneath the shadow of China’s wings, it is displays such as these that have sent several Southeast Asian nations scrambling to replace their ageing air force equipment with planes of the kind used by the increasingly assertive superpower. A report released in February by British defence and security analysts IHS Jane’s forecast that Asia-Pacific defence spending would hit a staggering $533 billion per year by 2020 – up from $435 billion in 2015. China alone accounts for nearly 40% of this outlay, having expanded its defence budget by 43% to $191 billion in just the past five years.

China’s ongoing occupation and increasing militarisation of several disputed islands in the South China Sea has been one of the driving forces behind this burgeoning arms race – though for many of the other claimants, the sheer size of China’s economy gives it an overwhelming advantage in the struggle for the skies.

Kaj Rosander, the Saab Group’s regional director for exports of the Gripen fighter jet in the Asia Pacific, told Southeast Asia Globe that the scramble for a modern air force was partly due to territorial concerns.

Creating open, green spaces combined with adequate natural light and ventilation in new apartments are some of the key areas Phnom Penh needs to focus on when it comes to sustainable urban development.

Catherine Sherwin, an Australian urban planner and business lead with Phnom Penh-based development consultancy firm Agile Development Group, said there were some great things about Cambodia’s capital city, but noted the city was facing some challenges with regards to liveability.

“Phnom Penh is undergoing rapid urbanisation at the moment and certainly rapid high rise development,” Sherwin told Post Property.

“All the apartment buildings are getting built so close to each other, so there isn’t much natural light or natural ventilation.

“The mental health and well being of those people living in those spaces with not much natural light is diminished which is why it’s important to have those outdoor areas for people,” she added.

Niece of Revered Tibetan Monk Calls His Death Murder, Asks For Investigation

The niece of a popular Tibetan religious leader who died last year under suspicious circumstances in a Chinese prison says that the widely respected monk was murdered in custody and has called for an investigation into the circumstances leading to his death.

Tenzin Delek Rinpoche, 65, died in prison in July 2015 in southwestern China’s Sichuan province while serving a life sentence imposed for what rights groups and supporters have described as a wrongful conviction on a bombing charge.

He was widely popular among Tibetans for his efforts to protect Tibet’s traditional culture, religion, and environment.

Speaking to the press on Thursday in Dharamsala, India, Nyima Lhamo—who successfully escaped from Tibet into India earlier in the week—said that when she and her mother, Tenzin Delek’s sister, finally viewed the dead monk’s body after being blocked in their efforts by authorities, “I saw that his mouth had turned black.”

“We accused the authorities of having killed Rinpoche by poisoning him,” Lhamo said.

Sovantha union protest draws wrath of FTU

The Free Trade Union (FTU) yesterday asked the Labour Ministry to take legal action against social media celebrity Thy Sovantha and student activist Srey Chamroeun for claiming to represent unions and workers at a protest.

On Sunday, the duo and 100 garment workers took to Freedom Park to protest CNRP leader Sam Rainsy’s pitch to the EU to put pressure on Cam-bodian garment industry imports to effect change.

FTU deputy president Man Seng Hak said the two had violated articles 80 and 81 of the Trade Union Law, which prevents people from operating a union without registration. As evidence, they cited letters sent to City Hall requesting permission for the rally.

Sovantha’s letter states: “We are representatives of unions and workers from about 10 factories which have 110,000 employees.” Sovantha and Chamroeun said they had not claimed to be representing workers or unions.

European Union representatives yesterday met with the National Assembly’s commission on finance and banking to ask about oversight of Cambodia’s national budget, which has long been the subject of criticism for its lack of transparency.

According to EU Ambassador George Edgar, the EU officials met with the commission members at the assembly in the morning and were given a presentation by the commission’s chairman, CPP lawmaker Cheam Yeap.

After the presentation, EU officers quizzed the commission about its oversight role in budget preparation and budget execution, said Edgar, who declined to comment on the commission’s capacity.

“Discussions included the structure and functioning of the commission, the process for approval and review of the Budget Law and the Budget Settlement Law, as well as follow up of the annual audit reports,” he said.

Since the Paris Peace Accords of 1991 Cambodia has not moved forward an inch in reality on the political and democratic front. It could be argued that civil society has on the whole made some gains - refugees along the border returned home, international assistance of various kinds poured in, people are allowed to eke out a living in relative freedom, a minority even thriving through large and small businesses, and of course, large-scale violence caused by armed conflict brought to an end. 

Yet, for too long such gains have been made possible at a price; benefits that maybe considered disproportionately overshadowed or outweighed by the costs and sacrifices to a nation's long term sovereignty and freedom. In the early 1990s and before, and despite his misgivings over his main protagonist in Mr Hun Sen, Sihanouk would have envisaged that the ending of the armed conflict between the various factions could have at least created a climate of "dialogue" and reconciliation among Cambodians; that perhaps, even these human instruments and puppets of Hanoi would gradually see sense and return to the national fold for the sake of the nation. After all, as he always maintained in private and public, they are 'Khmers' too. He also saw in Sen [who was promoted to the post of Premier at a young age] something of his own self; a young "statesman" isolated on the international stage and alone in leading a war-torn nation. Thus, from having previously referred to Hun Sen as "One-Eyed traitor" Sihanouk would later embraced the man as his adopted son [at the latter's request] and asked him to accept and abide by the terms of the PPA, and more importantly, to give him the assurance that the monarchy and the throne would be reinstated and preserved. 

It's conceivable too to envisage during this early stages how the likes of Sihanouk would have been deceived and swayed by Sen's pledges and empty reassurances; many among his former enemies have fallen prey to his charm and tactics; a trend that has persisted to this day with regards to the manner in which he manipulates and deceives the CNRP leadership - at times. Since the violent coup to eliminate the electoral threat of the opposition in Funcinpec in 1998, Sen has tolerated the appearance or facade of political pluralism, along with his solemn pledge to "protect" the King and monarchy as the foremost symbol of national unity and entity, but he has done so mostly on his own terms. The political opposition parties and their lively presence [as long as they pose no serious threat to the CPP's political survival] would lend his rule legitimacy of sorts and the pretense that the PPA has not been violated whilst the sterilised, subservient Monarch conveys similair impressions of unity and consensus between the ruling elite and the country's still revered royal institution. 

It is thus no surprise to hear Rainsy refers to Sihanouk as "Our King" in his latest spat with the present regime over the Heng Samrin defamation case against him. Sihanouk may well be "Our King" and a national Hero to Sihanoukists and to some others who have either through misled views or blind following refused to come to terms with the reality and enormity of his crimes and blunders. Yet the realities confronting the nation today are in part direct consequences of his fatal political decisions and legacies, and thus to continue to revere him or his memory would be to perpetuate and validate all of his flaws and errors that would surely and speedily lead to a national suicide. 

Remember too the injury and insult Sihanouk's veneration will have caused to those innocent millions who endured 'unparalleled sufferings' and to the memory of their relatives and loved ones who lost their lives in the seventies owing to his "royal legacies" or misjudgments. 

Pin your visions and leadership on Truth and the Khmer people's Will and desires instead. That should be more than enough in the long run in the national struggle for independence and freedom.

Cambodia National Rescue Party (CNRP) leader Sam Rainsy was found guilty Thursday of defaming a leading lawmaker in a trial the opposition leader told RFA was based more on “politics and corruption” than an impartial judicial review.

The Phnom Penh Municipal Court convicted Sam Rainsy of defaming National Assembly President Heng Samrin in a closed-door session that lasted less than an hour. Heng Samrin is also a senior leader in the ruling Cambodian People’s Party (CPP).

While Sam Rainsy did not attend the trial, Heng Samrin and his attorney Ky Tech did. Sam Rainsy was fined 10 million riels (U.S. $2,439) and ordered to pay Heng Samrin 150 million riels (U.S. $36,586) in compensation.

Accused Kem Ley killer not cooperating: ministry

1- The suspected 'assassin' not wearing a mask [was he meant to be identified to conceal the identity of the real killer?], 2- wearing double shirts in a very warm climate [was he planning to rid of the top shirt after the killing, or was the shirt previously worn by someone else who committed the deed?], 3- why was he caught so quickly by the police forces after the incident? [was there a routine police presence near and around the gas station that had not been out of the ordinary prior to the incident?], 4- was the suspect's given name - 'choub somlab' [meet-to-kill] something he made up in a hurry because that was his code-name and instruction for the assignment, or was he instructed to use the name [along with the story about the money debt owed to him by the victim] to preempt the suspicion as to the motives and identity of those behind him and the killing?, 5- why has the close-circuit camera video footage not been released or discussed by the authorities? Is it because they want to protect the sensitive details of the investigation, or because the captured details in the footage compromise the true identity and masking of the mastermind[s]?  


Note point 4 indicates that the organiser[s] had not thought through carefully over the credibility of the pretext used to explain the assassination i.e. that the victim owed the killer some few thousand dollars. The circumstantial and material contrast between the 'assassin' and the victim invalidates the claim, casting even more suspicions as to the identity of powerful forces behind the scene and the suspect. 

Yet, ultimately and credible or not, this kind of random elimination of, or attack on,  the regime's perceived critics and dissidents would invariably conclude with the politically aligned and partial court system. If this suspect had not been found to front the killing, the high profile nature of the crime itself would have necessitated the arrest and prosecution of some other innocents as scapegoats to complete the story - as had been done with the killing of the trade union leader and activist Chea Vichea - or by eliminating the lead - as was the case with the Chhut Wutty murder. It is reported that the families of the men who violently attacked the two opposition law-makers recently have even moved to a bigger house after their respective heads of household have been imprisoned! This stands in stark contrast to the circumstances of families of those opposition figures and activists currently detained in prison who are suffering severe financial and economic hardships.  

In essence, this pattern of killings has been in vogue since the organised mass killings in the 1970s that have made the country synonymous with "genocide" and brutality around the world. That this particular suspect even has a past in the Pol Pot military [presumably as a young recruit along the border with Thailand before joining the non-communist resistance faction, and later on the State of Kampuchea regime] and of peasant background is interesting and pertinent. The rank and file, as well as the base or grass-roots, of the KR movement consisted of Cambodia's overwhelming rural population; semi-literate or illiterate and easily susceptible to communist indoctrination and propaganda persuasion. There were many prominent 'Kem Leys' then whom the KR targeted and executed, along with a wholesale class of educated population by order of that same mysterious and invisible power behind the scene. Had these thousands of the nation's educated people not been murdered, it is unlikely that the present regime that Hanoi put in place in 1979 would have survived to this day; nor would the country have been raped and plundered on the same devastating scale with such impunity. At least, not without provoking a more widespread or populist revolt and unrest within the ranks of the populace...

Oeut Ang, 44, the alleged killer of political analyst Kem Ley, is not answering investigators’ questions and has refused to acknowledge his parents, according to a senior Interior Ministry official.

“The perpetrator did not answer anything and did not recognise his parents,” Interior Ministry spokesman Khieu Sopheak told local news outlet Kampuchea Thmey yesterday.

Sopheak, who could not be contacted by the Post yesterday, also said the security camera footage from the Phnom Penh petrol station where Ley was shot on July 10 had been sent to court and would be released once the investigation was completed, though he did not provide a time frame.

In a video released by police, Ang called himself Choub Samlab or “meet to kill”, and initially “confessed” to killing Ley because he owed Ang $3,000; however, interviews with the suspect’s wife, mother and neighbours have cast some doubt over that motive.

Eight opposition politicians in Thailand are facing sedition charges, the latest government crackdown on dissenting voices as a vote on a new Thai constitution draws near 

As a referendum on Thailand’s draft constitution approaches on 7 August, eight politicians loyal to former Thai prime minister Yingluck Shinawatra are facing sedition charges for spreading “false information” about the constitution in letters distributed to supporters.

Deputy prime minister Prawit Wongsuwan said on Thursday that the group would be detained for at least another week and would be tried before a military court.

“These arrests, and hauling the suspects into military detention, absolutely contravenes Thailand’s international human rights obligations,” Brad Adams, executive director of Human Rights Watch’s Asia Division, told Al Jazeera. “The charge of sedition is being used like a hammer to pound anyone that says things the military junta doesn’t like.”

The new constitution has been touted as a solution to a decade of political upheaval that reached a new chapter in 2014 when Thailand’s military overthrew the elected government of Yingluck Shinawatra. If passed, the constitution will become will become Thailand’s twentieth since the absolute monarchy was abolished in 1932.

“We see it as a return to a period where you don’t have people confronting each other on the streets,” Constitution Drafting Committee spokesman Norachit Sinhaseni said in March.

Potentially damning archives from Khmer Rouge-era provincial prisons were “systematically destroyed” in the district controlled by former Senate president Chea Sim for political expediency, expert witness Henri Locard told the Khmer Rouge tribunal yesterday.

Locard told the tribunal it had failed to adequately investigate the brutal crimes committed inside provincial prisons in general, even as it delved deeply into the regime’s notorious S-21.

While written confessions and photographs from S-21 – as well as the physical premises (today the Tuol Sleng Genocide Museum) – are extant, records of the smaller prisons that Locard said dotted every district are rare.

“There are Tuol Slengs all over the country,” he said, adding the court’s intense scrutiny of the capital’s prison – many of its inmates Khmer Rouge cadre – was like an investigation of the Nazi regime examining only Auschwitz.

The legal woes of Sam Rainsy continued to mount yesterday as the self-exiled opposition leader was found guilty of defaming National Assembly President Heng Samrin in a Facebook post, a conviction that carried no jail time but a hefty fine.

In November, Rainsy, a prolific Facebook user, posted a video of the late King Father Norodom Sihanouk along with a text message accusing the Samrin-led 1979 government of trying Sihanouk in absentia for treason and sentencing him to death in a show trial.

Phnom Penh Municipal Court judge Ros Piseth took less than an hour to hear arguments from public prosecutor Vong Bunvisoth and Samrin’s lawyer Ky Tech before pronouncing Rainsy guilty of defamation under Article 305 of the Criminal Code.

“According to the evidence given by the complainant’s lawyer, there is consistency in that there was a case of defamation through a post on Facebook,” he said.Rainsy, who did not send a lawyer to represent him, was ordered to pay Samrin 150 million riel (about $37,200), as well as a separate 10 million riel fine to the state.

The government has approved a new mass round of military promotions, elevating 120 officers to brigadier general, giving two stars to a further 87 generals and elevating two people to lieutenant general status.

Published in the government’s June royal book, the 210 promotions add yet again to the Royal Cambodian Armed Forces already “bloated” upper echelons, with one national security analyst estimating the military has in excess of 3,000 generals.

Contacted yesterday, Defence Ministry spokesman Chhum Socheat said the advancements were based on merit and capacity and followed requests by commanders within RCAF units.

But observers, and one insider, were yesterday quick to slam what they saw as yet another example of rewarding loyalty within the Kingdom’s unwieldy armed forces, whose top brass have recently drawn condemnation from the United States for their partisan support of Prime Minister Hun Sen and the ruling Cambodian People’s Party.

At the Lord’s Gym, forgiveness comes with a mean left hook. This small, single room lined with mirrors, mats and punching bags in Svay Pak – an area on the outskirts of Phnom Penh once teeming with child sex abuse and trafficking – is intended as a place to gather sex traffickers to work out, read the bible, and pray.

The website of Christian charity Agape International Ministries (AIM) presents a testimonial showing what this method can achieve, using the test case of Sokunthy – not his real name – who was “notorious for trafficking young girls” but attended the Lord’s Gym every day, “where he was prayed for by the staff [and] heard the truth about the evil he was perpetuating within the community”.

One day, the AIM staff discovered Sokunthy had raped two very young girls; his sisters, aged 6 and 9. Their pastor approached Sokunthy: “You know, we hate what you did. But the truth is, the gym is the Lord’s gym. And no matter what you’ve done, he’ll forgive you.”

He returned as a prodigal son, went to church, and “[t]hrough the power of prayer and the working of God’s Holy Spirit, he has not hurt another child and is completely transformed”, the testimonial ends.

Foreign direct investment (FDI) to Cambodia over a 20-year period – from 1994 to 2014 – is estimated to have reached $19.2 billion and was heavily weighed by inflows of capital from China, according to the first-ever comprehensive survey on FDI, released yesterday.

The National Bank of Cambodia (NBC) and National Institute of Statistics (NIS) jointly conducted the survey in an effort to provide a definitive data set on FDI that reflects the actual investment situation in the country.

Chea Serey, director-general of NBC, said without this data, policymakers and researchers rely largely on figures given by investors of committed investment when they seek approvals for their projects at the Council for the Development of Cambodia (CDC) – and most of these figures do not reflect the actual amount they end up investing. While previous figures showed Cambodia was receiving a large inflow of FDI, there was suspicion as to whether the numbers reflected real investment.

“Earlier, what we have seen was only the recorded number [of FDI], which is not consistent to the actual amount of investment we got,” she said. “So, we decided to do the survey in order to find the data to compare it to the actual situation.”

Two twin activists who fled Cambodia, claiming they feared for their safety, have been granted United Nations refugee status and have applied for asylum in the US, according to one of the brothers and an organisation supporting them.

Chum Hour and Chum Hout left for Thailand in the wake of the July 10 murder of political analyst Kem Ley, who the twins met shortly before his death.

Speaking yesterday, Hout said the pair had received refugee status from the United Nations High Commissioner for Refugees on July 27 and, represented by two lawyers, had applied for asylum in the US and hoped to “leave soon”.

Hout said they had received advice to leave the country from a “big organisation” in the wake of Ley’s shooting, which many believe was politically motivated.

“We are comfortable and happy that IKARE and people in the USA have worked very hard to help,” Hout said of the organisation which is paying for the twin’s shelter and legal representation.

Reached by phone yesterday Kosel Sek, executive director of Minnesota-based IKARE, which works with genocide survivors and helps Cambodian students visit the US, said there was no fixed timeline for the asylum claim.

“The attorney has expressed his optimism that it will be days not weeks or months but it’s a process we’re not in control of,” Sek said, adding his group felt compelled to help the brothers reach safety and “tell their story”.

Concerning today’s decision by the court in Phnom Penh relative to the defamation case brought against me by Heng Samrin, I would like to make two remarks:

1) The proclamation of a republic generally follows the abolition of a monarchy. Such events mean the physical or political elimination of a monarch. When the new authorities formed after 7 January 1979 proclaimed their “People’s Republic of Kampuchea,” they did express their intention to eliminate former King Norodom Sihanouk from the political scene. Even though they did not call for a physical elimination associated with a death sentence – it was the Lon Nol regime that sentenced Norodom Sihanouk to death after the proclamation of the “Khmer Republic” in 1970 – they really wanted to eliminate/kill Norodom Sihanouk at least from a moral and political point of view. The “Khmer Republic” and the “People’s Republic of Kampuchea” had the same intention and showed the same spirit in their actions when it came to trying to eliminate our former King Norodom Sihanouk. In the first half of the 1970’s and throughout the 1980’s, the two regimes grossly insulted and defamed our former King. They nurtured the same anti-monarchy and anti-Norodom Sihanouk spirit, and this is the most important point to consider in this case.

2) On my 17 November 2015 Facebook post – which is the cause for the lawsuit – I did not mention anybody’s name and just referred to the “regime born on 7 January 1979.” However it is Heng Samrin, as an individual and in his current capacity as President of the National Assembly of the Kingdom of Cambodia, who is now suing me for “defamation” on behalf of the “People’s Republic of Kampuchea.” On what legal and judicial grounds is Heng Samrin entitled to do so on his own? Has there been a prior decision by the court or any relevant authorities allowing him to sue me on behalf of the “regime born on 7 January 1979”? Or is this lawsuit a personal dispute? One day in the future, when victims of the deadly K5 Plan implemented under the “People’s Republic of Kampuchea” are allowed to take legal action before an independent court, who will designate whom to face the court and to respond to charges possibly associated with crimes against humanity? Will Heng Samrin appear again?

“This is the first time we come to the ACU for help,” said Sovann. “If the ACU cannot deal with this issue and tell us whether it is related to corruption, that means the ACU is incompetent.”

About 40 members of the “SOS” airport community gathered in front of Anti-Corruption Unit (ACU) headquarters yesterday to demand an investigation into Por Sen Chey District Governor Hem Darith.

Darith has forbidden community members from building new houses or altering land ownership in the long-disputed area, said Kao Sovann, deputy leader of the community.

According to a letter issued by the Council of Ministers, permission must be granted to construct new buildings or modify the land around the airport. But residents say the governor is violating the law by not even considering their requests.

ACU chief Om Yentieng said his unit plans to look into the complaint as soon as possible. Residents, meanwhile, say they’ll give the ACU three weeks to respond to their complaint before they petition the Council of Ministers.

The ELCs are not meant to 'reduce poverty' in the first place. No other countries have compromised their political independence and territorial sovereignty to the same extent. These are in essence, political schemes that legitimise the taking over and exploitation of a country's land and natural assets by foreign states largely disguised as corporate investors, whilst denying the indigenous population the right to own and till the land as their ancestors had done. Some observers have likened the phenomenon and risks posed to the Ukraine crisis which has seen its eastern parts and the Crimea invaded and taken over by the foreign state with vested interests: Russia.

Economic land concessions (ELCs) are supposed to be transforming Cambodian agriculture into a heavyweight industry and raising the living standards of millions of rural Cambodians, according to government policy documents.

But, in an academic paper published last month, Arnim Scheidel, a PhD in ecological economics at the Erasmus University in Rotterdam, argued that poverty reduction is merely a cover for what he terms “land capture”.

Cambodia’s “poverty crisis” – the World Bank estimated 3 million Cambodians were living below the poverty line in 2012 – has been taken as a tool to legitimise land capture, Scheidel wrote, with “the proposed solution [to the crisis] . . . clearly biased towards the establishment of capital-intensive large-scale agribusinesses”.

ELCs are billed as transforming rural subsistence farmers into paid plantation employees, according to Scheidel, who terms this a “strategic depiction” that “dismisses that more than half a million self-employed farmers have lost land, livelihoods and environmental incomes” to concessions.

“From the perspective of agro-investors, who in Cambodia are strongly tied to ruling party elites, there are also strategic reasons to define poverty as issues of employment and monetary income,” he wrote, arguing that these definitions “[favour] large agro-projects with formal jobs and incomes over small-scale peasant ways of life.”

PHNOM PENH, July 28 (Xinhua) -- A Cambodian court on Thursday ordered self-exiled opposition leader Sam Rainsy to pay a compensation and fine of 160 million riel (40,000 U.S. dollars) after the court found him guilty of defaming National Assembly president Heng Samrin.

"The court orders Sam Rainsy to pay a compensation of 150 million riel (37,500 U.S. dollars) to the plaintiff and a fine of 10 million riel (2,500 U.S. dollars)," said the verdict pronounced by Phnom Penh Municipal Court judge Ros Piseth.

The verdict was released after a 40-minute hearing in which the plaintiff's lawyer was present, as Sam Rainsy and his lawyer were absent.

Heng Samrin filed a defamation suit against Sam Rainsy in December after the opposition leader posted a video clip on his Facebook page in November, claiming that Heng Samrin, who was the top leader during the 1980s regime, had indicted late King Norodom Sihanouk of being a traitor and sentenced him, in absentia, to death.

Sam Rainsy, leader of the main opposition Cambodia National Rescue Party, has been in self-imposed exile in France since November to avoid a two-year-prison sentence in a 2008 defamation case brought by Deputy Prime Minister Hor Namhong.

The Vietnamese government yesterday agreed in principle to provide a grant of $2 million to Cambodia to build a model market aimed at boosting cross-border trade between the two countries, officials at Cambodia’s Ministry of Commerce said.

The market will be constructed on 1.5 hectares in Kandorl village, in the Memot district of Tbong Khmum province, about 1 kilometre from the nearest Cambodia-Vietnam border crossing, according to Mao Thora, a secretary of state at the ministry.

“The market will be a place to sell both Cambodian and Vietnamese goods, of which I think most of our goods are agricultural products,” he told reporters after the signing of a memorandum of understanding for the project.

“It will play a role to facilitate trade by people living along the market and improve their livelihoods,” he added.

Beleaguered CNRP leader Sam Rainsy was found guilty this morning of defaming National Assembly president Heng Samrin in a Facebook post last November.

The trial, which was over in the span of an hour, centered on a Facebook post in which Rainsy alleged that the Heng Samrin-led government of 1979 convicted the late King Norodom Sihanouk for being a traitor and sentenced him to death in a show trial.

Following a 10-minute deliberation, Phnom Penh Municipal Court judge Ros Piseth said Samrin’s complaint was consistent with Rainsy’s post and that the CNRP leader was guilty under Article 305 of the criminal code.

“Based on the facts and evidence, the court finds out that there is enough evidence against the accused, Sam Rainsy, for public defamation committed on Facebook page of Sam Rainsy on November, 17, 2015,” said Piseth.

The Cambodian delegation, in its attempt to block a joint statement by the Association of Southeast Asian Nations (Asean) in Vientiane, over the grouping's standpoint on the South China Sea, is evidently working for Cambodia's own benefit and against that of the regional grouping.

This is not the first time Cambodia has acted against Asean's combined interests. In 2012, as host and chair of Asean, Cambodia prevented Asean foreign ministers from releasing a joint statement after their annual gathering in Phnom Penh.

Issuing a joint statement after a yearly meeting has been a custom in practice for Asean ever since the grouping's formation in 1967.

Hence, Cambodia's membership in Asean should be seriously reconsidered by the grouping - for its own survival, unity and prosperity.

Sometimes, a finger needs to be cut off in order to save the rest of the body.

As mourning for popular pundit Kem Ley draws to its close, the investigation into his murder turns up no new leads, and key witnesses and supporters go into hiding, Cambodia appears to be following a script that should now be familiar to all Cambodians.

“This is not the first time intellectuals, patriots, and activists who fought to rescue our country have been slain,” Cambodia National Rescue Party (CNRP) President Sam Rainsy said on RFA’s Special Discussion Show. “I have noted that the slaying of activists follows the same well-orchestrated style set by the authorities.”

While Sam Rainsy didn’t directly accuse Prime Minister Hun Sen’s government of carrying out the fatal attack, he recited a litany of killings that he claims all have similar hallmarks. These killings would be impossible to carry out with official cover, he said.

“Those include the grenade attack [on an opposition political rally] on March 30, 1997;  the killings of well-known union leader Chea Vichea, and two other union leaders, namely Ros Sovanareth and Hy Vuthy; as well as Chut Wutty and the recent case of Dr. Kem Ley,” he said during the July 23 broadcast.

Thousands of cubic metres of endangered Siamese rosewood were sent to Vietnam in 2014 with export permits bearing the Photoshopped signature of a retired Ministry of Agriculture, Forestry and Fisheries (MAFF) secretary of state, a ministry official said yesterday.

The trade in Siamese rosewood was internationally outlawed under the Convention on International Trade in Endangered Species (CITES) in 2013. The next year, in spite of the ban, nearly a million cubic metres were registered in the database of the CITES secretariat in Geneva as having been exported to Vietnam from Cambodia in six batches.

When this discrepancy was first brought to light last month by British NGO Environmental Investigation Agency (EIA), the Cambodian CITES management authority – a department within MAFF responsible for granting trade permits for protected species as well as annually reporting on the trade to the secretariat – said it was unaware of the exports.

CITES Cambodia’s 2014 report to the secretariat in Geneva listed just two Siamese rosewood trees being exported – to Canada. If the Vietnamese management authority had registered imports from Cambodia, those imports must have been conducted with counterfeit permits, CITES Cambodia officer Suon Phalla said in an email last month, adding that his office was unaware of any such forgeries.
