Dear members of the Cambodian-American community,
As you may know, the Cambodian government may be just days away from finalizing a draft Cybercrime Law that would seriously impinge on the right to freedom of expression online. Though the government has so far refused to release an official copy of the draft law, a version leaked earlier this year would effectively criminalize online speech that is critical of the government or of politically connected individuals. Critically, this law could also give Cambodian authorities extraterritorial jurisdiction to prosecute "crimes" committed outside of Cambodia. This means the law could potentially affect millions of individuals who exercise their rights to free expression outside of Cambodia, including many Cambodian-Americans, bloggers and international journalists.
The Cambodian Center for Independent Media, or CCIM, is the legal entity behind Voice of Democracy news (www.vodhotnews.com) -- one of Cambodia's only politically independent, local, Khmer-language news networks. We are currently joining with a coalition of Cambodian NGOs in petitioning the government to release an official copy of the draft law and to engage in meaningful consultation on the law before finalizing it.

លិខិតចំហផ្ញើជូនរដ្ឋាភិបាលនោះ ចុះហត្ថលេខាដោយតំណាងអង្គការសង្គមស៊ីវិលចំនួនជាង៥០។ សង្គមស៊ីវិលទាំងអស់ ទាមទារឲ្យរដ្ឋាភិបាលផ្តល់សេចក្តីព្រាងច្បាប់ចំនួន៦ រួមមាន សេចក្តីព្រាងច្បាប់ស្ដីពីឧក្រិដ្ឋកម្មអ៊ីនធឺណិត (Cyber Crime Law or Internet Law) សេចក្តីព្រាងច្បាប់ស្ដីពីទូរគមនាគមន៍ សេចក្តីព្រាងច្បាប់ស្ដីពីសហជីព សេចក្តីព្រាងច្បាប់ស្ដីពីការបង្កើតសមាគម និងអង្គការមិនមែនរដ្ឋាភិបាល ព្រមទាំងសេចក្តីព្រាងច្បាប់ស្ដីពីការប្រើប្រាស់ និងគ្រប់គ្រងដីកសិកម្ម ជាដើម។
សង្គមស៊ីវិល ថែមទាំងស្នើសុំឲ្យរដ្ឋាភិបាលផ្សព្វផ្សាយសេចក្តីព្រាងច្បាប់ទាំងនេះជាសាធារណៈ មុនពេលដាក់ជូនគណៈរដ្ឋមន្ត្រីពេញអង្គពិនិត្យ និងអនុម័ត ហើយនិងបញ្ជូនទៅកាន់រដ្ឋសភា។ សង្គមស៊ីវិល ក៏ចាត់ទុកថា ការបើកចំហព័ត៌មានជាបទដ្ឋានមួយដែលរដ្ឋាភិបាលត្រូវតែធ្វើ ដើម្បីពង្រឹងអភិបាលកិច្ច។
ប្រធានលេខាធិការដ្ឋានគណៈកម្មាធិការប្រព្រឹត្តិកម្មនៃអង្គការសមាគមការពារសិទ្ធិមនុស្សហៅកាត់ថា ច្រាក់ (CHRAC) លោក សួន ប៊ុនស័ក្តិ មានប្រសាសន៍ថា ការផ្តល់ឱកាសឲ្យប្រជាពលរដ្ឋ និងសង្គមស៊ីវិលចូលរួមផ្តល់យោបល់លើការអនុម័តសេចក្តីព្រាងច្បាប់ ជាប្រការប្រសើរបំផុតដែលអាចធ្វើឲ្យច្បាប់ទាំងនោះមានលក្ខណៈគ្រប់ជ្រុងជ្រោយ និងបម្រើប្រជាពលរដ្ឋទាំងអស់មិនប្រកាន់និន្នាការណាមួយទេ។ លោកបន្តថា គណបក្សកាន់អំណាចមិនគួរណាប្រកាន់ជំហរត្បិតត្បៀតព័ត៌មានតទៅទៀតឡើយ៖ «មធ្យោបាយដែលប្រសើរនោះ គឺបក្សណាដែលដឹកនាំរដ្ឋាភិបាល បក្សនោះត្រូវតែធ្វើគោលនយោបាយឲ្យល្អ ហើយបើគោលនយោបាយមិនល្អ នៅតែរឹតត្បិតព័ត៌មានដដែល បក្សនោះនឹងដាំក្បាលចុះមិនខាន ឬបាត់បង់ប្រជាប្រិយភាពជៀសមិនរួច»។
ប្រទេសកម្ពុជា ធ្លាប់សន្យាចំពោះអន្តរជាតិ ក្នុងកិច្ចប្រជុំត្រួតពិនិត្យជាសកលកាលពីឆ្នាំ២០០៩ ស្តីអំពីសិទ្ធិមនុស្សថា កម្ពុជា នឹងពង្រីកដំណើរការពិគ្រោះយោបល់លើការបង្កើតគោលនយោបាយ ការតាក់តែងច្បាប់ ដើម្បីធានាថា រាល់លិខិតទាំងនោះត្រូវបានវាយតម្លៃរួចរាល់លើផលប៉ះពាល់ទាំងវិជ្ជមាន និងអវិជ្ជមានលើបញ្ហាសិទ្ធិមនុស្ស។ ក្នុងគោលនយោបាយយុទ្ធសាស្ត្រចតុកោណរបស់រដ្ឋាភិបាលតាំងពីឆ្នាំ២០០៣ មកនោះ បានយកអភិបាលកិច្ចល្អ ឬការគ្រប់គ្រងល្អជាគោល។ គោលការណ៍អភិបាលកិច្ចល្អ អាចប្រព្រឹត្តទៅបាន លុះណាតែមានការចូលរួមពីសំណាក់ប្រជាពលរដ្ឋ។ ប៉ុន្តែ ការរៀបចំសេចក្តីព្រាងច្បាប់នាពេលកន្លងទៅ មិនបានផ្តល់ឱកាសឲ្យសាធារណជនចូលរួមពេញលេញទេ។ ច្បាប់បីពាក់ព័ន្ធនឹងវិស័យតុលាការ ដែលគណបក្សប្រជាជនកម្ពុជា រៀបចំ និងអនុម័តដោយឯកបក្សនោះ បានទទួលការរិះគន់យ៉ាងខ្លាំងពីសំណាក់សង្គមស៊ីវិល ថាច្បាប់ទាំងនោះនឹងផ្តល់អំណាចឲ្យក្រសួងយុត្តិធម៌ មានឥទ្ធិពលលើប្រព័ន្ធតុលាការ។

Once the cyber-crime law comes into effect against the oversea Cambodians, including the Cambodian Americans, the real question is:
"What about the past crimes committed by the Cambodian Americans?"
I am a search engine expert and can dig up a lot of old comments from Kmenhwatt and other oversea Khmer who wrote horrible things about the Queen Mother. They wrote the Queen Mother being a Vietnamese whore, committed nasty orgy acts with multiple men for years. Last year I confronted them and they stopped.
So, can Cambodia pursue these trouble makers and bring them to justice? They need to be punished.
The problem with the Khmer race is they can only see with their eyes, and lack the imagination to see from the other people point of views. They would commit horrible crimes and view that it's normal. Other people would say, "Oh dear God, for heaven's sake, please stop these evils."
But of course, the Khmer folks don't understand other people are horrified. They viewed it's their rights to do what ever they like. So, we must apply the law and teach these Khmer to behave. Go argue with the batons, the batons will win.
