Sourn Serey Ratha, firebrand president of the newly legalised Khmer Power Party, wasted no time in lashing out at Cambodia’s two main political parties following his arrival at the Phnom Penh airport yesterday morning, saying he wanted to create a joint alliance of smaller parties to counter their influence.

Speaking upon his return from self-imposed exile in the United States, the Cambodian-American nationalist railed against the leaders of the ruling Cambodian People’s Party and the opposition Cambodia National Rescue Party for their long terms in office and incompetence.

“I will only stop criticising the government as long as the government stops doing wrong,” he said, surrounded by about 100 supporters.

Ratha, once branded a “terrorist” by Prime Minister Hun Sen and sentenced to seven years in jail over a Facebook post that urged the overthrow of the government, was pardoned in July in a move some analysts said was made to swell the field in hopes of splitting the opposition vote.

But Ratha dismissed that allegation yesterday, adding that he hoped to unite with other small parties currently without seats in Cambodia’s parliament.

“We know there are parties in the National Assembly who received votes from citizens, just not enough [to gain seats],” he said. “So we want to seek an alliance to struggle for a joint political platform, not create only one party.”

A remote jail opened more than five years ago to lessen chronic overcrowding in the prison system is also operating as a farming business, where free labour is seemingly used to yield big profits for senior staff.

When Correctional Centre 4 (CC4) opened its gates in January 2010, it was slated to become the largest prison in the country, with space for about 2,500 inmates. But most of the complex was never completed, while large swathes of the grounds are allegedly used by a small number of officials for personal gain.

The Interior Ministry’s General Department of Prisons (GDP) touted CC4 as a solution to the well-documented issue of overcrowding, which has left inmates across the country – including those in pre-trial detention, children and the mentally ill – in squalid conditions, without adequate food or amenities.

But more than five years on, the prison, which is situated on a sprawling plot of land in rural Pursat province, is home to fewer than 250 inmates. Purported plans to build infrastructure to house thousands more never materialised.

“Originally, five ‘branches’ were planned for construction and each was proposed to house 500 prisoners, but this has not happened. Only two ‘branches’ have been constructed and the capacity of each is significantly less than 500,” said Nou Sam An, prison supervisor at local rights group Licadho.

The failure to accommodate the intended numbers means “there has been no appreciable difference in the prison overcrowding rates across the country since CC4 accepted its first prisoners”, he said, adding that the rate of overcrowding remained at more than 170 per cent.

Unlike most of the country’s prisons, when you approach CC4, you are greeted not by walls and razor wire, but hundreds of acres of farmland.

Forgery and Incitement Charges Without Basis

(New York) – Cambodian authorities should end the prosecution of an opposition senator who has been wrongfully charged with forgery and incitement for posting online an inaccurate version of a 1979 Cambodia-Vietnam treaty, Human Rights Watch said today. The next hearing in the case against Senator Hong Sok Hour is scheduled for October 2.

Hong Sok Hour, a dual Cambodian-French citizen who represents the Sam Rainsy Party (SRP) in the Senate, was arrested on August 15 on public orders from Prime Minister Hun Sen. He ordered Sok Hour’s arrest after he posted a video clip on the Facebook page of Sam Rainsy, president of the main opposition Cambodia National Rescue Party, of which SRP is a founding party. The authorities denied Sok Hour bail, and he is being held pending trial. The judge in the case has refused to allow him to receive a specialist medical examination and possibly necessary treatment for hypertension and cardiac disease.

“Relations between Cambodia and Vietnam are politically sensitive, but they are no excuse for bringing criminal charges over a disputed document,” said Brad Adams, Asia director. “The Cambodian government has already pointed out that the document was inaccurate and in a democracy the matter should be left at that.”

There is no basis for forgery and incitement charges, which should be dropped and Hong Sok Hour immediately and unconditionally released.

Hun Sen has turned an inaccurate historical statement into a criminal offense to crack down on the political opposition and demonstrate that he can arrest and imprison anybody, anytime. Cambodia’s donors should not let Hun Sen and his government get away with stifling free expression and the democratic process, but should jointly and publicly call for those practices to end.

The video at the center of the case contained a Khmer-language text purporting to be article 4 of the February 18, 1979 Treaty of Friendship between Cambodia and Vietnam, which was made public at the time. Shortly after the video was posted, a secretary of state at the Council of Ministers declared the version it presented of article 4 was “fake.” In ordering Hong Sok Hour’s arrest, Hun Sen characterized the posting of the video as an “act of treason.”

Most contentious was a sentence saying that Cambodia and Vietnam had supposedly agreed to “dissolve” the border between the two countries. Issues related to the border have been a matter of controversy and concern in Cambodia for many decades and have recently been the subject of an outpouring of public discussion, including by both government and opposition politicians.

The long-exiled leader of the “People’s Power” movement, Sourn Serey Ratha, returned to Cambodia on Thursday, following a pardon for the crime of treason by King Norodom Sihamoni in July.

Sourn Serey Ratha had been accused of leading an anti-government movement and had been on the lam abroad since 2013.

Addressing reporters on his return to Phnom Penh International Airport Thursday, he said Cambodia’s election body remains flawed, while the opposition has become too closely tied to the ruling party.

“We want a free and fair election, not an election to continue the new government mandate with the same leaders,” he told reporters. “The People’s Power Party wants Cambodia to be the winner. If the election system is not changed to make a free and fair election, the Cambodian people will still be the losers.”

The People’s Power Party will join with other smaller parties to contest upcoming elections, he said, attacking issues around the National Election Committee, Vietnamese citizen’s voting in Cambodian elections and other alleged irregularities.

The 14-day Kan Ben Festival begins on Sept 28, 2015 in the pagodas throughout the country. This year, this annual religious festival will take place untilOct. 11.

As usual, Cambodian people go to pagodas to offer foodstuff to the monks. They believe that the monks will then convey the offering to their late ancestors.

Kan Ben is part of “Pchum Ben” Festival or the Festival for the Dead, one of the biggest festivals in Buddhism. This religious festival, which falls on the fifteenth day of Kan Ben, is to celebrate this year on Oct. 12.

Cambodia's casino industry generates close to $2 billion in revenue a year and accounts for nearly 40 per cent of the Kingdom’s tourism revenue, a central bank official said yesterday.

Chea Serey, director-general of the National Bank of Cambodia, told a workshop on statistics in international trade in services that Cambodia’s proportion of casino revenue to total tourism receipts followed only that of Macau and Monaco.

“I’m not talking about the absolute amount, but the relative proportions of casino income to total travel revenues,” she said.

Serey added that the revenue figure took into consideration not only income generated at gambling tables, but also other ancillary sectors across the tourism spectrum.

“We mean tourists who come to casinos and spend money [at casinos], hotels, restaurants and buying goods in the market,” she said.

Cambodian law prohibits its nationals from gambling in its casinos, Serey noted, adding that most gamblers entering the Kingdom were from Vietnam, Thailand and China.

Indonesia, the world’s third-biggest rice consumer, is looking to place a mammoth government-to-government order to import 1.5 million tonnes of rice, but state-owned rice exporter Green Trade said yesterday that it has no plan to enter a bid.

Heang Vutha, director-general of Green Trade, said he was not contacted by the Indonesian government and had been unaware of the prospective rice deal. However, the volume requested and the November-through-January delivery date ruled out any Cambodian participation.

“We will not have enough rice for them, and the timeframe they have set is too short,” he said, adding that Green Trade only has the capacity to deliver 2,000 tonnes of milled rice per month.

Indonesia’s vice president last week said his country plans to import 1.5 million tonnes of rice to avert a spike in prices as the effect of the El Nino weather phenomenon cut into domestic supply.

“We are forced to import because of the drought,” Indonesian Vice-President Jusuf Kalla told local media.

“We’re taking rice issues very seriously. We could delay imports of chilies or shallots, but when it comes to rice, we’re not playing around.”

Bulog, Indonesia’s state rice procurement agency, was reportedly looking to Thailand and Vietnam to fill the order.

Minister of Interior Sar Kheng has called on police to tighten the noose on both the unauthorised use of official police licence plates among their own ranks, and on the use of fake police plates by the public at large.

It is illegal to use official police plates on personal vehicles, as it is to use the fake plates, which are widely available for less than $10, and often used in the commission of crimes by perpetrators hoping to avoid scrutiny.

“There is a small amount of police officials who have been using vehicles carrying police number plates in violation of the traffic law and other laws, and [have been] allowing non-police to use the numbers or using vehicles with police number plates to serve private interests, which affects the dignity, honour, and prestige of the National Police,” Kheng wrote in a September 25 letter, which was obtained yesterday.

Kheng went on to acknowledge the use of fake plates by criminals, and also reminded officials that police plates were no excuse for not paying taxes on their vehicles. The letter called for street-side checkpoints, as well as checks at police stations themselves.

Situation ripe for strikes: study

Short-sightedness, weak adherence to the law and poor working conditions in Cambodia’s garment sector are creating a fertile field for strikes to prevail over negotiations, a recent study released by the Arbitration Council Foundation, an independent labour mediator, has found.

According to the study, incidents of striking have considerably increased in the disputes the council mediated, going from 17 in 2012 to 94 in 2014. While compensation issues were by far the most common demands in strike cases the council oversaw – making up 37 per cent of all cases during a one-year period from April 2014 to 2015 – it was far from the only factor enabling the proliferation of strike action.

Because many employers offer only the most minimal protections required by the law, strikes are not used as a last resort but as a negotiation tactic, the study says, beginning on an “ad hoc basis rather than as part of a campaign to achieve broad based CBAs [collective bargaining agreements]”.

CBAs, or governing contracts drawn up between unions and employers, are seen as smoothing industrial relations by avoiding the use of strikes while setting up clear standards for workers.

But a range of issues hamper the effective implementation of CBAs in Cambodia, according to the report, such as the lack of a separate labour court to handle cases involving a wide number of demands.

“An inability to promulgate various claims at one time and achieve a longstanding resolution in the form of a CBA provides many more ad hoc opportunities for strikes to occur,” the report reads.

PHNOM PENH (Khmer Times) – The government yesterday moved to reassure Internet users and NGOs fearful of a censorship crackdown after plans to implement new controls to combat cybercrime and the abuse of social media.

A draft sub-decree announced last month gives the Interior Ministry’s new Anti-cybercrime Department powers to deal with abuse, but there are no plans to block sites.

Under the draft, the Anti-cybercrime Department, according to the sub-decree, will be mandated to monitor mail, phone calls and faxes, searching for “irregularities relating to national security.”

“The Internet environment in Cambodia is more favorable because there is no restriction to any website. You can even access porn sites here,” Sun Rapid, Director of R&D Center at the Ministry of Telecommunications, said at a gathering of NGOs and government officials to discuss Internet freedom.

He said Cambodia ranks third in the region for Internet access, after Singapore and Malaysia.

There have been a series of arrests recently over material posted on the Internet, most notably an opposition senator for posting what is allegedly a doctored border treaty as part of a campaign against the government over border demarcation talks with Vietnam.

But officials and some NGOs say the atmosphere here is still relatively free.

“Overall, the Internet freedom in Cambodia is more open. There is no blocking or censorship of any websites or applications,” Cambodia Community Legal Education Center (CLEC) information communication and technology project coordinator Ngeth Moses said.

Like 17% of people in Cambodia, the family live in extreme poverty, subsisting on less than $1.25 a day. Rihorn’s daughter Channa, 12, supports her mother and brother Pov, nine. She goes to school in the morning and works to earn money in the afternoon and evening. She shines shoes and weighs people on her scales, charging 100 riel per client. Channa explains how she got the scales: “Shortly before my grandmother died, she was given $20 by a passer-by. She told my mother to buy something that was an investment to earn money.”

Rihorn, 42, lives in the Cambodian capital, Phnom Penh. She is divorced from an abusive husband. “I am not well and can no longer work to support my children,” she says. “Sometimes I am so sick that I cannot cook or clean and my children do not have food to eat. A few weeks after my second child was born, I became sick due to childbirth – we call it toas. I have a stiff backbone, I’m hot and feverish, and my uterus and fallopian tubes hurt. I don’t know how to cure it and so I have bought different kinds of medicine in the hope that I will find a cure.”

Rihorn: ‘Sometimes I am so sick that I cannot cook or clean and my children do not have food to eat.’

Rihorn explains that she has had three miscarriages due to carrying heavy loads while pregnant. “I used to have high fever during the pregnancies. I would call the traditional birth attendant to massage my uterus, and it costs 20,000 riel ($5) each time. It costs more if it involves the traditional attendants touching my blood. Each time I needed to pay the traditional attendant, I would borrow money. For 10,000 riel I pay back 16,000 riel. I now owe 100,000 riel for food and taking care of my sickness.”

Channa and her family – along with the other slum dwellers – were evicted from their home in 2006 and left to fend for themselves in the countryside.

In 2006, Channa and her family – along with hundreds of other slum dwellers – were evicted from their home. “They told us we were being taken to new homes,” says Channa. “They promised us the deeds to a ‘bungalow’. But we were driven 45 minutes into the countryside, where there was nothing.”

There, they tried to fend for themselves, making a shelter from plastic sheeting. Overnight, the land flooded. There were no jobs in this isolated place, and Channa struggled against the financial pressure to become a “waitress” – a euphemism for a sex worker in Cambodia.

The message is clear: Criticise Hanoi or Vietnam's policies over Cambodia and you risk being labelled "racist" or "anti-Vietnamese"! If an ethnic Vietnamese falls off his bed or toilet seat and dies from broken neck, he must be a victim of Cambodian racism? A Vietnamese coffee shop was ransacked; no one was injured, but this is sufficient evidence needed to prove the link between "anti-Vietnamese rhetoric" from CNRP politicians and mob violence?

Before any of these incidents had even taken place, the Opposition leadership pleaded with its supporters NOT to use violence; 'not even so much as to touch a single hair on anyone's head' - in Sam Rainsy's words - in the course of their public activities and demonstrations before and following the July 2013 general election. Not that I personally want to wish ill on any Vietnamese person, or want to see innocents hurt. But, in fairness, given the historical context of the two countries' turbulent uneasy relations, the recent military occupation of Cambodia by Vietnamese troops, the sacrifices in thousands of Cambodian lives resisting that occupation, the numerous counts of killings and assassinations meted out to even prominent figures within the Hanoi-installed regime itself to ensure that only the most subservient and compliant among them would be retained to advance Vietnam's geo-political interests, the assassinations of Khmer Krom and other Cambodian monks, the killings of opposition and trade union activists, the brutal deployment of armed forces to quell unarmed [unless you count sticks and stones as arms deserving of lethal military response?] protesting workers and so forth, in addition to the public clamour for a change in how it wants to be governed, it is something of a miracle, and in my understanding, owing in no small measure to the CNRP leadership's deliberate decision to embrace a peaceful 'non-violent' struggle for change that we had - and have - not witnessed bloodshed on a far greater scale. Unless, again, one excuses killing unarmed innocents as an example of the regime's "genius", because at least this helps restore "national stability"?

What did the peoples of Europe, France, Britain, Scandinavia, Russian etc. do when their nations were either under Nazi German military occupation, or faced with the spectre of that occupation and invasion? Well, among other things, they had to arouse their masses' patriotic fervour [Stalin - a 'communist' - said his country/Soviet Union was waging the 'Great Patriotic War' against the invaders], and yes, that necessarily entailed a certain amount of 'anti-German' rhetoric and feed. I doubt, the people of Russia have quite forgotten or forgiven the Germans for or over all their great endurance and sufferings. 20 million Russian/Soviet lives, in fact, consumed in that conflict. The point is: were all these peoples 'racist' too, or had their leaders been guilty of using the "race card" in their respective national war effort?

To Hanoi: Stop interfering in Cambodia's national affairs; respect her right to exist as an independent nation; the right to self-determination; honour international treaties which you had signed; respect her territorial sovereignty and borders; agree to the French government's proposal to jointly request French technical assistance in mapping the border line between the two countries, instead of locking away nationalists and critics in jail for even daring to question the status quo. Then, and only then, will we be nearer to resolving the underlying tension and strife that still engulf this long suffering country today.

Investors in Vietnam, as well as China, have been linked to the spate of evictions that have left 20 percent of Cambodians without land.

In a democracy, the people get the government they deserve. Part of the CPP and Prime Minister Hun Sen’s genius is a remarkable ability to soothe race consciousness among the ethnic people, the majority Khmer Buddhists, the resident expatriate foreigners who practice a multitude of religions, the Chams and of course the Vietnamese who have been here for decades.

On one trip to Cambodia, then United Nations human rights envoy Surya Subedi had said: “I am alarmed by the anti-Vietnamese language allegedly used in public by the opposition.” Before his visit, a Vietnamese-owned coffee shop was looted in an escalation of an already deeply worrying trend.

In yet another case, a man of Vietnamese descent but born in Cambodia, Tran Van Chien, was mercilessly beaten to death after a traffic altercation when some bystanders yelled, “Yuon were fighting Khmer”. The result: He is dead and his pregnant Khmer wife became a widow.

One of the few local voices that have condemned this anti-Vietnamese rhetoric and violence is the president of the Cambodian Center for Human Rights (CCHR). For his trouble, Ou Virak received death threats and a torrent of appalling abuse over the Internet.

When asked by Asian Correspondent about this latest incident, he responded: “Who knows where it could lead, with these level of frustration, racism and hatred, all it needs is something to ignite it for it to get out of hand.”

PHNOM PENH (Khmer Times) – A border research team from the Royal Academy of Cambodia has been studying a multitude of maps and inspecting old border posts, some of which have been in place since French colonial rule, in an effort to calmly resolve the border issues between Cambodia and Vietnam.

Yong Pao, a research team member, said the group is not only finding and inspecting border posts against border maps, but also checking and verifying a new set of demarcation border posts recently set by the government.

“In 11 days, the research team has discovered 12 colonial-era border posts... which were used to demarcate the border between Cambodia and Vietnam by French colonial generals,” Mr. Pao said.

“Initial results from the research disclosed that the current demarcated border posts by the government with Vietnam are completely correct and the same borderline of the 12 colonial-era border post were based on the Bonne maps... produced by French colonial generals,” Mr. Pao said.

“As planned, we need two years to conduct and complete our mission because Cambodia shares a border of 1,270 km with Vietnam,” he added.

The government has borrowed historical maps held by France and the UN to help settle the issue of where the disputed border lies. The dispute has delayed further negotiations with Vietnam while the government defends the process against allegations by the opposition Cambodia National Rescue Party (CNRP) that it is ceding land to Vietnam.

“They [CNRP leaders] always accused the government of using a fake [map] to demarcate posts,” Mr. Pao said. He described that allegation as “baseless.” Prime Minister Hun Sen has publicly slammed the opposition party for turning the border dispute into a political issue, saying they turned a sensitive process into a dangerous political farce.

Following weeks of quarrelling, the Kingdom’s garment unions yesterday agreed to demand a monthly industry minimum wage of $168 – only to find themselves miles apart from employers who are refusing to consider an increase beyond the rate of inflation.

Leading up to ongoing tripartite minimum-wage talks slated to culminate in October, pro-government and independent unions debated between demanding $158 or $178 a month, with one league of independent unions even offering a target of $207 based on a survey of garment workers’ spending habits.

But yesterday, 14 unions settled on the $168 figure after more than an hour of internal discussion, according to a statement released after the meeting.

“Some of our unions used to demand different figures, such as $158, $166 and $178, but today we decided to take only one figure for negotiation with employers coordinated by the government,” said Fa Saly, president of the National Trade Union Confederation.

However, employers have shown no indication they are ready to make significant concessions to labour. Employers have thus far only agreed to increase salaries by the rate of inflation, which, based on a current rate of 3.5 per cent and the current minimum wage of $128, amounts to slightly less than $4.50 a month.

Ken Loo, spokesman for the Garment Manufacturers Association in Cambodia, said the union and government sides had failed so far to prove to employers that there was a solid economic rationale for an increase in the minimum wage.

“So far, their number has got no meaning,” Loo said.

A Vietnamese national was arrested yesterday in Kandal province for allegedly illegally fishing in Cambodia’s Tonle Sap river.

Men Seng, chief of staff at Koh Thom district police, said 35-year-old Guyeng Yaing Ya was arrested in Sompov Poun commune, where officers seized evidence including a motorboat and 17 fishing nets.

The suspect was charged with “illegal border crossing and illegally fishing in the prohibited season using illegal fishing equipment”, Seng said.

Thun Chetna, an officer with the Sangkat Chaktomuk district Fishery Administration, which cooperated in yesterday’s arrest, said Yaing Ya was being questioned yesterday afternoon.

Chetna said Yaing Ya is likely to be deported. The motorboat will now be kept as state property, while other seized items will be burned.

He added that continued efforts are needed to stop further fishing offences.

“Despite the fact that a crackdown has been launched and fishing is prohibited in breeding season, and that serious fines have been introduced, fishery crimes keep happening.

It means that all of the involved authorities need to observe and crack down regularly.”

Land dispute pits PM’s brother against Brigade 70 general

RCAF’s Brigade 70, which formerly included Hun Sen’s Bodyguard Unit, has in the past been accused by rights groups of everything from illegal logging to political arrests and even murder.

The Kampong Speu Provincial Court has joined the fray in a land battle between Hun Sen’s elder brother and a general attached to RCAF’s infamous Brigade 70, ordering a halt to its clearing.

A court officer, joined by 20 local authority officers and several members of local NGO Natural Resource and Wildlife Preservation Organization (NRWPO), on Friday went to the disputed property, where they kicked out the general’s workers, who were clearing the land with four tractors. No one was arrested.

Hun San, the premier’s brother and director of the Cambodia Shipping Agency, bought a parcel of land from villagers in Kampong Speu’s Oral district in 1999.

Since then, RCAF Major General Khay Narin, assisted by land brokers Thorng Sokheng and Ly Lun, has purchased land that allegedly overlaps San’s property by 1,000 hectares, according to San’s lawsuit, which was filed with the provincial court in July.

Narin started clearing the land earlier this year to plant sugarcane, cassava, pepper and cashew, according to the lawsuit. Provincial court judge Chem Rithy issued the injunction against the clearing on August 19.

“His Excellency Hun San asked for a [court order] to protect and ban any activities on the lands, because those can cause loss of his land,” said Rithy. “The possession [by] the opponent’s side will affect his legal right [to] the land.”
