Nhiek Bunchhay sues Khmer Amatak newspaper

Mr. Nhiek Bunchhay, Secretary General of Funcinpec Party and Deputy Prime Minister, has sued the editor of Khmer Amatak newspaper, Mr. Bun Tha, who is affiliated with the Norodom Ranariddh Party, for defamation after the newspaper published an article and documents accusing him of corruption in the sales of many party headquarters and pocketed the money.

Mr. Bun Tha was summoned to appear before the Phnom Penh Court on Friday, 18th March, by the court prosecutor Mr. Hing Bun Chea.

The 46 year-old editor, who claimed that he has been intimidated into silence, said he is trying to find a defence lawyer. "It is not a political motivation, but it is an intimidation of the press (into silence). We have all the documents with the original logo of the party. This is a personal issue, but when it became public, he (Nhiek Bunchhay) try to intimidate or to to break (my) spirit", he said.

On Monday, Mr. Bun Tha published an article and documents accusing Mr. Nhiek Bunchhay of corruption and embezzlement of party funds.

Mr. Nhiek Bunchhay claimed the documents are fake and decided to sue Khmer Amatak newspaper after Mr. Bun Tha refused to meet him personally to obtain the authentic doucments before publication. "I've told him that for that issue please come to see me first, I will show all the documents because there are many documents, not only that one. Before publication please come to see me, to see the real documents first before publication because it is the freedom of the press, but he did not get any documents from me at all (before publication)", he said.

In mid February, many disgruntled Funcinpec members of the Steering Committee had leaked many documents bearing Mr. Nhiek Bunchhay's signatures which showed he had secretly mortgaged the party headquarters and officies to two Chinese companies for more than $6 million, but the party did not receive the money. Mr. Nhiek Bunchhay threatened to sue those Funcinpec officials, but a compromise was reached and he withdrew his threat.

Mr. Bun Tha was not new to controversy. In July 2010, he was sued by Dr. Kao Kim Hourn, Secretary of State of Ministry of Foreign Affairs, after he published an article and documents purporting to show corruption and irregularities in charging fees to prospective applicants for the Japanes government scholarships. The suit was later dropped after a compromise.
