Cambodia's 7-point proposal to implement the ICJ decision

Cambodia Proposes a Draft Agreement for Showing Its Stance on the Border Issue with Thailand

AKP Phnom Penh, July 22, 2011 –Prime Minister Samdech Akka Moha Sena Padei Techo Hun Sen said Cambodia proposed a draft agreement with Thailand to implement the order of the International Court of Justice (ICJ) dated on July 18, 2011.

The Cambodian premier said this during a press conference held today at the Peace Palace in Phnom Penh.

The draft agreement has been sent to Thailand, Indonesia, The Hague, and the United Nations Security Council in the purpose of showing the Cambodia’s stance on the border issue with Thailand.

Here is the draft agreement, of which three are seven points proposed by Cambodia.

In compliance with Paragraph 69 of Order 2011/18 July/ General List/ No. 151 (hereinafter the “Order”) of the International Court of Justice (hereinafter the “Court”), the Royal Government of Cambodia and the Government of the Kingdom of Thailand (hereinafter referred to as the “Parties”) hereby undertake, in cooperation with the Chair of the Association of Southeast Asian Nations (hereinafter the “ASEAN”), to carry out the following:

1. With a view to implement the immediate withdrawal of all military personnel from the Provisional Demilitarized Zone (herein after “PDZ”) as defined in Paragraph 62 of the Order, each Party, in cooperation with the Indonesian Observer Teams, shall inform the Court on the details of its military personnel and their positions, as of 18 July 2011, within the PDZ;

2. With a view to ensure Cambodia’s free access to the Temple of Preah Vihear and to maintain normal administration within the PDZ, each Party, in cooperation with Indonesia, shall report to the Court on the status of any non-military activities as of 18 July 2011 within the PDZ.

3. After the entry into force of this Agreement, both Parties request the speedy assignment and dispatch of the Indonesian Observer Teams, on behalf of ASEAN, as indicated in Paragraph (B) (3) of the order, and as agreed in Paragraph 10 of the Statement by the ASEAN Chair on 22 February 2011 in Jakarta;

4. Once the Indonesian Observer Teams are in place, the Parties shall cooperate with the Indonesian Observer Teams to determine the location on the ground of Points A, B, C and D of the PDZ (in accordance with the coordinates as specified in Paragraph 62 of the Order);

5. Both Parties, in cooperation with the Indonesia observers, shall draw up a timetable for the immediate withdrawal of all their respective military personnel from the PDZ;

6. In accordance with Paragraph 61 of the Order, this Agreement shall not prejudice the works of the GBC and JBC with a view to demarcate the border and assure security and order at the border;

7. The assignment of duties, responsibilities and Terms of Reference for the Indonesian Observer Teams and responsibilities of Cambodia and Thailand in facilitating the mission of the Indonesian Observer Teams shall be defined in a separate agreement to be signed between Cambodia, Thailand and Indonesia, in accordance with Paragraph 69 of the Order of the Court.

Cambodia shown leadership in solving the dispute. I like that. Thailand probably doesnt have any real solution, just blowing hot airs. Cambodia should inform ICJ the proposed solution. Who is taking charge now? Keep doing what you are doing. PM Hun Sen, I like your style. Hit them every corners so that they know who is in charge in this. Dont allow the theift to dictate when and how to move the troops. You take the intiative and tell the theift what to do. If the theift doesnt like then tell them to take it up with ICJ.

Blood, you don't even know what you're talking about. Cambodian "always" initiated the process. Go back from the beginning of the conflict since 2008. Don't just open your mouth non-stop like 7/11.

The commentor must be Thai's supporter. You must be scare that Cambodia is playing offense more than ever. Warrior Blood wanted Khmer to take more charge that is why he lit the fire under government ass with his 7/11 mouth. You dont mind right? unless you are Thai, then off course you dont like his comment. I am sure we can't glorify on the past.

I agree with 3:32 AM. This is the first time that Cambodia is being proactive on this issue. Since 2008, Cambodia has been led by the nose by Thailand on every talk. Thailand dictated the terms of the meetings, that's why all meetings have failed. However, I commend the Cambodian government's firm stance against bilateral talks with Thailand and applauded its proactivity on the ICJ ruling to come up with the 7-point proposal. But, soon Thailand will dictate and lead Cambodia by the nose again because of its intransigence and military superiority. If Thailand refused to abide by the ICJ and refused to implement the ICJ decision, then the next step for Cambodia is to ask the UN Security Council to enforce the decision or just wait for the permanent verdict which is another 3-4 years away. And in the meantime, there is a risk that armed clashes might occur if troops from both sides are not withdrawn.

I just read RFA, the clashes is happening; one Cambodia soldier dead and Thai's casualty is unknown. I am not too optimistic with ASEAN leadership either because this Marty guy canceled his trip before when Cambodia and Thailand situation get heated. I am afraid he might cancel his trip again or find some excuses not to come. Cambodia should have plan B if ASEAN leadership failed. I am doubtful that Thailand listen to ASEAN. I dont think Thailand respect ASEAN leadership especially this Marty guy.
