Cambodia opposition says it welcomes talks with ruling party, but only after voting probe

Cambodia's opposition is insisting that an independent committee to investigate allegations of cheating in the recent election be established before it holds talks with Prime Minister Hun Sen's ruling party on establishing a new government.
The opposition Cambodian National Rescue Party declared its conditions Thursday after Hun Sen's offer to hold party-to-party talks and support a probe into the polls.
Hun Sen's Cambodian People's Party has said the provisional election results show it winning 68 of the National Assembly's 123 seats, with remaining 55 going to the opposition party.
The opposition claims that more than 1 million people may have been deprived of their right to vote because their registrations were not properly processed. On Wednesday it [the opposition] claimed it had won a majority of 63 assembly seats.

Reality Check: Which Party is in Favor of Winning this Election?

By Vorackcheat
Depending on our judgement and the reliable data, which party is in favor of winning this election?
-The CPP have claimed their victory over this election based on their own and the NEC's data-- 68 seats to 55 seats.
-The CNRP have also claimed this election victory based on their own reliable data from all polling stations throughout the country--63 seats to 60 seats without verifying on numerous irregularities yet.     The following factors have led both parties to claim the same victory:

The CPP's Strength:
-The oldest political party in the country, created in 1951 as the Khmer Revolutionary Communist Party originated from the Indochina Communist Party founded by Ho Chi Minh in 1930.
-Well-prepared and strong built networks of support from grassroots all over the country
-No new introduced policies but maintain the current ones and proud of their achievement
-All levels of local administrations from group leaders, village chiefs to provincial governors, military, police, courts under the CPP's control
-The CPP controlled NEC is the state apparatus to guarantee the CPP continuous victory.
-Financial strength-- the CPP get millions of dollars of financial support from their rich business tycoons, Okya and high government officials in exchange for their business privilege and positions
-Superior media access-- all TV stations, most radios and news papers under the CPP's control
-Election manipulation-- set up systematic electoral fraud via the NEC throughout the country, creating ghost lists, double and triple name lists, deleting voters' names suspected of the opposition supporters, making them difficult to register and to find polling stations, buying votes, and intimidation.

The CPP's weakness
-Has been installed by Vietnam and has ruled the country since 1979,  long enough for the people
-Most people have viewed that the CPP as a tool of Hanoi to swallow Cambodia in the near future, as witnessed in this election--All Vietnamese were allowed to vote freely while many Khmers had no names to vote.
-The CPP-run government is among the most corrupted regimes in the world
-Dictatorship, ruled by one man
-Unequal economic growth, the rich get richer while the poor struggle to survive
-No social justice for all, only a small privilege group
-Miscalculate the support from the people, especially the youths, Believing that power can create money and money can make black to White and white to black: a mentality of the CPP
-Lost faith and support from the people in all levels

The CNRP's strength
-Unity between the two democratic parties--the Sam Rainsey and the Human Rights Parties
-Gain popular support from all over the country
-Create the great 7 point policies for the people and the country
-promise justice, true democracy, and real independence for the country
-Restore Khmer sovereignty
-Gain strong support from all Khmer oversea and international community
-Financial strength : get financial support from regular members and donation from Khmer oversea
-Media access : get some coverages from independent radios and newspapers inside the country, many foreign radios such RFA, VOA, and FIR but dominated  on Internet networks and social media --Facebook, Youtubes, tweeters and so on.
-Most election campaign done by volunteer works

The CNRP's weakness
-New created party
-No big sources of financial support
-No equal media access
-The party leader was barred from candidacy and vote
-Not enough time for the party president to campaign
-The party's activists are constantly harassed and intimidated by the CPP's supporters
-Not well-prepared and organized, for most works done by volunteers
-The party's unity has not reached out to all other Khmer group or parties -- the 6 other smaller parties have wasted about a half million votes that the CNRP needed to win a decisive victory.

Based on the above factors, can you (the reader) express your opinion on which party is in your favor to win this election? The CPP or the CNRP ?

Wine [or whiskey] makes a good servant, but bad master...

Comical Whiskey of Phnom Penh - Long serving information minister and mouthpiece of the ruling CPP regime Mr Khieu Kanharith is sometimes likened to the late Saddam Hussein's Information Minister, dubbed "Comical Ali" by western reporters for the same dubious and miraculous ability in cooking up seemingly impossible reports for their respective governments. Thus, the results of the general election recently announced by him via Facebook only serve to indicate as to the veracity of the figures and outcomes of the election itself, the consequences of which will carry far reaching implications and impact upon the Cambodian nation one way or another - School of Vice

Note by School of Vice

If the NEC is not under the CPP's control and direction, why is it then that all its committee members are appointees of the Ministry of Interior, the security organ of the CPP?

Why have the recommendations of UN special rapporteur - Prof. Surya Subedi - concerning NEC reform fallen on deaf ears up to now?

What evidence is there by which to conclude that the reduction in the number of seats “won” by the CPP from 90 [2008] to 68 [2013] indicates that the NEC is not under the CPP's direction?

Is it possible that the CPP has lost to the CNRP by a landslide, yet somehow cooked up the results to show it still wins by a whisker?

What kind of results would now have been manipulated between the CPP and the NEC had it not been for the role and vigilance of some independent poll observers, CNRP voters and activists themselves on Election Day? Another guaranteed landslide victory for the ruling party as in previous elections?

The Injustice perpetrated against the Will and hopes of ordinary Cambodian people and voters by this shameless band of natural born swines and swindlers are enough to make the stones cry out!

Cambodian opposition raises new claim of election victory to keep pressure on government

Cambodia's opposition party has escalated its challenge to the country's election results, claiming it won a majority of National Assembly seats. The ruling party earlier made its own claim of victory in the Sunday polls.
Yim Sovann (pictured), spokesman for the opposition Cambodia National Rescue Party, said Wednesday that based on reports from party workers and election observers, his party had won at least 63 of the assembly's 123 seats. Party leader Sam Rainsy made the same claim late Tuesday.
Prime Minister Hun Sen's Cambodian People's Party earlier claimed it had won 68 seats to the opposition's 55. Provisional official results support the ruling party's projection.
The opposition has already called for an investigation of voting irregularities, including registration problems that could have disenfranchised more than a million people.

Cases of Voting Irregularities Show Election is Problematic [An international observer sees Cambodian election as problematic]

By Michael Liu
I am an international lawyer from China. I have been working in Cambodia on and off for two years now.
I became aware that China sent an official delegation to observe the general election, “China and Hungary Call National Election ‘Free and Fair”’ (Wednesday, page 19). As you correctly pointed out, there is no general election in China, meaning I was never eligible to vote in a fashion like my fellow Cambodians.
While I remain grateful to the Cambodian state and its people for giving me the opportunity to be an international observer despite my lack of experience in elections, I’d beg to differ from the view to generally categorize this election as “problemless.”
I, for one, without any soliciting, witnessed at least two incidents of voting irregularities on the polling day and was informed of many more from other sources.
Because of my personal experience, I do see some merit of taking a cautious approach when evaluating this election.

Cambodia’s Eerie Silence

Hun Sen is returned to power with a much slimmer majority. Will protests ensue?
800px-Elections_40365_02072008
An eerie silence has descended on Phnom Penh as strategists within the Cambodian People’s Party (CPP) digest the results of last Sunday’s election, which handed an embarrassing and uncomfortable win to Prime Minister Hun Sen.
His 13-seat majority in the National Assembly would be considered a solid win in most countries but in Cambodia, where Hun Sen has ruled with an iron grip for two-and-a-half decades, that margin is slim and compromised by alleged cheating that favored the ruling party.
Fears that cheats might prosper in this poll were common as campaigning came to an end late last week, when hundreds of thousands of people began the arduous task of travelling home, heading to remote provinces to cast their ballots. Analysts said that most had since delayed their return back to Phnom Penh amid scaremongering and wild rumors of opposition protests taking to the streets where a potential showdown with the government, police and the military seems unavoidable.
A vigil was held by Sam Rainsy at a memorial to commemorate the 1997 grenade attack which killed 16 of his supporters. About 800 people, including many monks, turned out to pay their respects, and the site will provide a probable venue for future protests.
“Sunday was the election, Monday was a public holiday and people should already be back from the villages where they went to vote. But many are staying put because they’re frightened of what might happen next,” one long term observer, who declined to be named, said.

Cambodia: UN Expert Calls For Free, Fair and Peaceful Elections, and Full Respect For Human Rights

Cambodia: UN Expert Calls For Free, Fair and Peaceful Elections, and Full Respect For Human Rights
GENEVA (26 July 2013) – On the eve of the National Assembly elections in Cambodia on Sunday 28 July, the United Nations Special Rapporteur on the situation of human rights in Cambodia, Surya P. Subedi, reiterates his call for free, fair and peaceful election that is underpinned by respect for human rights before, during and after polling day:
"Free political environment and the ability of the people to exercise their rights and freedoms, such as the right to vote, freedom of expression and assembly and the right to stand for election are the key to free and fair elections.
"Cambodia has made significant progress in strengthening democracy, human rights and the rule of law, and I call upon the Government to ensure full respect for its international human rights obligations as the country goes to the polls on Sunday.
"In the remaining hours, I urge the people of Cambodia to refrain from violence and have due regard for the rights of other fellow citizens when exercising their own. Every eligible voter must be given an equal opportunity to exercise his/her right to vote without intimidation, fear or pressure. Allegations of intimidation must be promptly investigated by the authorities.
"With regard to the National Election Committee (NEC), all complaints brought to its attention should also be promptly investigated, and if appropriate, remedied. It is not too late for many of the important concerns already raised to be addressed in a meaningful manner.
"At this juncture in the history of Cambodia, what is at stake is the credibility of the election, and thus also of the future governors of the Kingdom of Cambodia.

Cambodia opposition starts citizen complaints register

Posted Wed Jul 31, 2013

Cambodia's opposition Cambodia National Rescue Party has started registering complaints from people who were denied the right to vote during Sunday's elections.
People are complaining they were refused a voting ballot despite already registering, while others say strangers have voted in their place.
Many Cambodians have proven the indelible ink put on their finger to prove they already voted easily washed off.
Officials from the opposition CNRP say they have already received more than 1,000 complaints on the first day of the exercise, which will continue until August 10.
Similar events will be held in the provinces where the party believes most of the voting irregularities took place.
The findings will then be presented to Cambodia's National Election Commission in the hope of proving the opposition's claims of widespread electoral fraud.
CNRP's leader Sam Rainsy has given the government until the end of August to convene a joint inquiry into allegations of voting irregularities.
The government has so far rejected this proposal.
Prime Minister Hun Sen's Cambodian People's Party claimed victory on election night, announcing it had won 68 seats out of the 123-seat parliament to the opposition's 55, a result CNRP has rejected.

Opposition leader Sam Rainsy agrees to talks on disputed Cambodia election result

Cambodia's Opposition Leader Sam Rainsy has agreed to an offer of talks from Prime Minister Hun Sen to discuss claims of voting irregularities.
After suffering the worst election result in 15 years, the Prime Minister Hun Sen has extended an olive branch to the opposition Cambodian National Rescue Party, which has rejected the ruling party's results.
He also says he'd welcome an investigation into alleged voting irregularities, which has been demanded by the opposition.
Hun Sen's offer comes as as the opposition CNRP claimed that it had won Sunday's general election with a narrow margin of 63 out of 123 seats.
On election night, the ruling Cambodian People's Party (CPP) announced it had won 68 seats to the opposition's 55.
Hun Sen has called on the opposition leader Sam Rainsy to compromise and to attend his proposed talks, which would look at forming a new parliament.
"I wish to stress that it does not matter which political party won the election - the important thing is that our nation won," he said.
"I have told three of my senior party members to negotiate with Sam Rainsy and I hope that the talks process will go well, but if needs be I will talk to Sam Rainsy by myself."
Sam Rainsy has told Radio Australia's Asia Pacific program he'll attend the talks, but maintains his party won the poll, not Hun Sen's.
"We accept the dialogue, but the objective is to establish and expose the truth - nothing less," he said.
"We can move forward only once the truth is recognised by everybody, and the truth is that the ruling party, after ruling Cambodia for 34 years, has lost this election and there is a democratic change underway in Cambodia."
Hun Sen also says he's open to the idea of a multilateral inquiry into the election led by the country’s election commission in order to show transparency and to come to a resolution that everyone can accept.
Sam Rainsy says the Opposition wants the international community and the United Nations to oversee the inquiry.

CCHR Press Release - CCHR welcomes agreement by the CNRP and the CPP to investigate election irregularities

CCHR PRESS RELEASE - Phnom Penh, 1 August 2013

CCHR welcomes the agreement by both the CNRP and the CPP to participate in a joint committee to investigate election irregularities

Cambodian democracy has come a long way since the last National  Assembly elections held in 2008. Last Sunday’s polling, and the immediate run up to the vote, was marked by largely peaceful campaigning and a surge in participation of Cambodian youth. The preliminary election results indicate that many voters were not afraid to vote for change and that there is a viable political opposition in the Kingdom of Cambodia (“Cambodia”), arguably for the first time since the first democratic election held in 1993.

Despite these significant positives however, several patterns of irregularities have cast doubt over preliminary election results and the overall fairness of the election. As a result and in order to ensure that the right of the Cambodian people to a free and fair election is upheld, the Cambodia National Rescue Party (“CNRP”) and the Cambodian People’s Party (“CPP”) have agreed to the establishment of, and to their participation in, an independent joint committee to investigate election irregularities and to push for definitive NEC reform. This is a positive development for Cambodian democracy and has the potential – if undertaken truly independently – to produce credible solutions for all Cambodians.

CCHR President Ou Virak comments:

“The agreement by Cambodia’s two main political parties – the CPP and the CNRP – to cooperate and participate in a joint committee to investigate election irregularities is extremely positive and bodes well for the future of democracy in Cambodia. During this sensitive time, we would like to call on people to remain calm and to be patient, allowing for the investigations to be carried out in due course. We would also like to appeal to people to avoid whipping up tension through the use of threatening language and hate speech. Democratic change is on the horizon in Cambodia and we must refrain from actions that could jeopardize its fruition.”

Opposition leader Sam Rainsy said Tuesday that his party had won at least 63 of the 123 seats at stake in Cambodia’s weekend parliamentary elections, enough to form a government with a simple majority, disputing victory claims by Prime Minister Hun Sen’s ruling party.

“Based on calculations by activists at polling stations, the CNRP [Cambodia National Rescue Party] won at least 63 seats” in the National Assembly, the country’s parliament, Sam Rainsy told RFA’s Khmer Service.

“I hope that we won more, because that would allow the CNRP to easily form its own government,” he said, revealing for the first time his own estimate of the number of seats the CNRP grabbed in Sunday’s elections based on feedback from polling stations.

Sam Rainsy’s announcement came as he threatened to hold mass protests against the victory claimed by Hun Sen’s Cambodian People’s Party (CPP) and if the government refuses to hold investigations into election irregularities.

Hun Sen’s CPP claimed a narrow victory of 68 parliamentary seats on election night, down from 90 in the previous elections in 2008, citing its own assessment of initial results.

It also acknowledged that the CNRP had nearly doubled its number of seats from 29 to 55.

The National Election Committee (NEC), which manages Cambodia’s elections, has virtually endorsed the CPP findings although it has not announced the official results yet, an NEC official said.

Sam Rainsy said that his party has also been robbed of a firm victory because of irregularities that had marred the vote.

The CNRP claims that more than 1 million names had been removed from the voter lists, with a similar number of "phantom" voters added to them along with what it calls the duplication of about 200,000 names.

The United States voiced concern on Monday about reports of irregularities in Cambodia's weekend elections and called for a credible investigation, AFP reports.

"We urge all parties and their supporters to continue to act in an orderly and peaceful manner in the post-election period," State Department spokeswoman Jen Psaki said.

The Cambodian opposition rejected the results of the polls even though it made significant gains, saying it had been robbed of victory over strongman Premier Hun Sen.

"We are concerned by numerous reported irregularities in the electoral process," Psaki said, adding that Washington had long called on Phnom Penh "to address systemic flaws such as problems in the voter registry and unequal access to the media."

"We call for a transparent and full investigation of all credible reports of irregularities," Psaki told reporters.

It was the worst election result for Cambodia's ruling party since 1998, after the opposition was emboldened by the return from exile of its leader Sam Rainsy, even though he was barred from running.

Hun Sen's Cambodian People's Party (CPP) announced late Sunday it had taken an estimated 68 out of the 123 seats in the lower house, against an increased 55 for the Cambodia National Rescue Party (CNRP).

"We believe that, of course, the Cambodian people should have confidence in the outcome of the election," Psaki added.

Following Cambodian parliamentary elections, UN rights expert appeals for calm

31 July 2013 – A United Nations independent expert today appealed for calm and reconciliation in Cambodia, following the country’s “largely peaceful” presidential elections on 28 July.
“Sunday’s general election was a display of maturity in democratic exercise in the country,” said the Special Rapporteur on the situation of human rights in Cambodia, Surya P. Subedi, commending all political actors for the restraint that they displayed. “I congratulate the people of Cambodia on exercising their right to vote in a largely peaceful manner.”
According to media reports, Cambodia’s opposition party rejected the results, saying it had won the majority and claiming there had been irregularities during the election, which has led to tension in the country.
“I now call for calm and political reconciliation in the greater interests of the nation and appeal for acceleration in the process of reform of State institutions, including the National Election Committee, to ensure greater respect for people’s rights, genuine rule of law and stronger democracy in Cambodia,” Mr. Subedi said.
The Special Rapporteur also appealed to the people and all political actors “not to succumb to racial hatred, whether in person or through other means such as social media, and to contribute towards building a tolerant, cohesive and liberal democratic society.”

Cambodian leader agrees to opposition talks after disputed election

Hun Sen, the country’s longtime leader, said he is open to compromise after his Cambodian People’s Party (CPP) and the opposition Cambodian National Rescue Party (CNRP) both claimed victory in Sunday’s general election. The U.S. and European Union have expressed concern about voting irregularities.

Hun Sen, 60, has served as Cambodia’s prime minister for 28 years.

Cambodia's long-serving leader, Hun Sen, said on Wednesday his party was ready to talk to the opposition after both sides claimed victory in Sunday's general election, talking of the need for compromise but calling himself "prime minister elect.”
"We open our heart to compromise in order to create a parliamentary leadership," Hun Sen said while on an inspection of a bridge construction site, his first public appearance since the election and his first comments on the deadlock.
"We have to respect the people's decision and if we don't, and turn to violence ... that would lead to chaos in the whole country and this is not what people want to see," he said.
The election campaign and voting on Sunday were largely peaceful but Phnom Penh remains tense because of the political stand-off. Police and the military are maintaining a presence on the streets, although business is mostly back to normal.
Hun Sen, 60, has been prime minister for 28 years and has crushed dissent in the past while maintaining tight control through his Cambodian People's Party (CPP) and a network of business, government and military allies.
Earlier on Wednesday, the opposition Cambodia National Rescue Party (CNRP), said it had won the general election, stepping up its battle with Hun Sen's CPP, which has also claimed victory and rejected accusations of electoral fraud.
Yim Sovann, a lawmaker and spokesman for the CNRP, said it had won 63 seats in the 123-member parliament, with the CPP getting 60.
"This is according to figures of votes we collected from various provinces and this needs to be investigated," he told Reuters.
The government announced on Sunday that the CPP had won 68 seats, a sharp fall from its previous tally of 90 but beating what it said was the CNRP's 55.

Khmer Have Proven Themselves as the Descendants of Jayvaraman 7 in this Election

By Vorackcheat
Since the first day of election campaign, Khmer all over the country have shown their courage and determination to demand for social justice, true democracy, and true national sovereignty from Hanoi's domination, that we have never seen in our modern history. During the election campaign, tens thousands of people especially the youths bravely volunteered to help the opposition (CNRP) campaign. During the election day, as people lost their faith to the authority as well as the NEC to guarantee the free and fair election result for them, they actively participated in many different important roles such as the ballot owners, election monitors, and fraud detectors that had made this election a historic event for the country.

As we already have seen this election campaign marked the turning point for our country that never experienced this kind of election campaign in the past. Tens thousands of people pouring into the street  voluntarily helped campaigning for the opposition (CNRP) party courageously even the atmosphere was filled with intimidation from the ruling party. Because they are tired of the long corrupted dictatorship rule of the CPP which has been installed by Hanoi since 1979. The only hope for the future of the country is to change the current government that has served the Vietnamese interest over the Khmer's. As the Khmer, we are proud and grateful to all of our fellow Khmer brothers and sisters who have scarified their valuable time, energy, financial resources, and even their lives in order to save our motherland from Hanoi's domination and to bring a true democracy for our nation.

To reach their final goal of saving our nation from Hanoi's yoke and bringing the true democracy to our nation, they want to make sure that the opposition CNRP wins this election in dignity. During a long election day, our people were not only the voters but courageously participated in many activities that have contributed to the fairness of this election. After casting their ballots, most people did not go home; instead they stayed to watch their ballots to make sure they had counted them correctly. Some people acted as election monitors by watching all unusual activities and recording all incidents via their mobile devices in order to unveil the truths to the outside world; they successfully tried to prevent theVietnamese from voting in many polling stations and helped their fellow Khmer whose names were purposely deleted by the NEC, to vote. Other people got angry with the polling station chief when their names were deleted from voting list as a part of the systematic election fraud practised by the ruling party CPP.
As the Vietnamese were allowed to vote freely by the NEC and the authority while Khmer had no names to vote, this situation had turned into a boiling point for all Khmer. As the polling station chief refused to answer this question and made no effort to solve the problem for the people, the situation quickly  turned into violence. Two military police vehicles were burned down by the angry mob, and it took a while before the situation was brought under control. All these activities and incidents have clearly proven that Khmer no longer fear of intimidation; Khmer started to see who are their real enemies and friends; Khmer did not allowed any one to cheat them any more; Khmer started to unite and to protect themselves; and eventually Khmer have bravely proved themselves as the true descendants of our hero King Jayvaraman 7 who always viewed the suffer of his people is also his own suffer.

The provisional result of this election that indicated the CPP won this election contest totally has not reflected to the will of our people who have overwhelmingly demanded for change.  If this election held in a free and fair atmosphere without the systematic fraud set up by the CPP, the opposition party the CNRP would not just lose in a narrow margin (about 200,000 votes) but will win a landslide victory. The rejection of the election result by the CNRP is the right and lawful mean to do in order to protect the voices, the wills, and the rights of the majority of the people who have courageously casted their ballots for change. As the battle for election result has continued, all Khmer have learnt from the great experience of this election that has never happened in our country before. The solidarity and the active participation of the people in this election process have shown a great role model of the true descendants of our great ancestor Jayvaraman 7, that we have to carry on in order to fight for justice, true democracy, and true independence for our Khmer Nation.
