Sam Rainsy: ICJ decision raises the status of a thief to the same level as the house owner

Cambodian opposition leader Sam Rainsy (pictured) has strongly criticised the International Court of Justice's decision as unfair to Cambodia, saying the court had given a thief the same right as the owner of the house by ordering both the owner of the house, Cambodia, to withdraw troops from its own territory and the thief, Thailand, to withdraw from the Cambodian territory it has forcibly occupied.

Speaking during a telephone interview with Candlelight Radio from his exile in Paris, Mr. Rainsy said he is disappointed with the ICJ decision: "I'm very disappointed. There is no justice in this decision at all. This decision has given the thief at the same value as the owner of the house, based on the fact that Cambodia is the rightful owner of Preah Vihear temple and there has been a clear recognition from the ICJ in 1962. But now, (the court) has considered the owner of the house the same as the thief", he said.

Mr. Rainsy said the ICJ had given rise to a very bad precedent. "So it is like that: if any thieves to want to steal anyone's house and the owner complains to the court and the court decided that both the owner of the house and the thief must leave the house to allow time for the court to make a decision whether to give the house to which party", he said added.

ដោយ​មេដឹកនាំ​គណបក្ស​ប្រឆាំង​រូប​នេះ បាន​ពន្យល់​ដូច្នេះ​ថា​”ដូច​ជា​ចោរ​ ចង់​បាន​ផ្ទះ​គេ​​ម្ចាស់​ផ្ទះ​ទៅ​ប្ដឹង​តុលាការ​​ស្រាប់​តែ​តុលាការ​​សម្រេច​ថា ទេ ទាំង​ម្ចាស់​ផ្ទះ​ទាំង​ចោរ​ត្រូវ​តែ​ចុះ​ចេញ​ពី​ផ្ទះ​​​ដើម្បី​ទុក​ពេល​ឲ្យ​​តុលាការ ធ្វើ​ការ​សម្រេច​ថា ​តើ​ត្រូវ​ផ្ដល់​​ឲ្យ​​ទៅ​​ភាគី​ណា”។

ការ​នេះ​បាន​ធ្វើ​ឲ្យ​មជ្ឈដ្ឋាន ប្រជាពលរដ្ឋ​ខ្មែរ​ខ្លះ​រិះគន់​ចំពោះ​ពាក្យ​ប្រើ​នៅ​ក្នុង​​សាល​ក្រម​នោះ​ដោយ បាន​​ហៅ​ថា​ តំបន់​ជម្លោះ ហើយ​ថា​តាម​ពិត​វា​ជា​តំបន់ ដែល​រដ្ឋាភិបាល សៀម​បាន​លើក​ទាហាន​មក​ឈ្លាន​​ពាន ​កាល​ពី​ថ្ងៃ​១៥​ខែ កក្កដា ឆ្នាំ២០០៨ រហូត​មក​ដល់​ពេល​នេះ។

យ៉ាង​ណា​ក៏​ដោយ រដ្ឋាភិបាល​ខ្មែរ​បាន​ទទួល​យក​សេចក្ដី​សម្រេច​នោះ របស់​ICJ​ ហើយ​ថា បាន​​ឆ្លើយ​តប​​ទៅ​នឹង​គោល​បំណង​ ដែល​កម្ពុជា​ចង់​បាន ។ហោ ណាំហុង បាន​ថ្លែង​កាល​ពី​ព្រឹក​មិញ​ថា វា​នឹង​ធ្វើ​​ឲ្យ​តំបន់​ប្រាសាទ​មាន​សន្តិភាព។

ប៉ុន្តែ​គណបក្ស​ប្រឆាំង​បាន​លើក​ឡើង​ថា ICJ ជា​ជម្រើស តែ​មួយ​គត់ សម្រាប់​បក្ស​កាន់​អំ​ណាច។ដោយ ​លោក សម រង្ស៊ី បាន​ថ្លែង​ថា ទឹក​ដី​កម្ពុជា មិន មែន​បាត់​តែ​ភាគ​ខាង​លិច​ទេ​ នៅ​ភាគ​ខា​ង​កើត​​អាច​បាត់​ច្រើន​ជាង។ហើយ​មធ្យោបាយ​ដោះ​ស្រាយ​ដ៏​មាន​ប្រសិទ្ធ​ភាព​នោះ ត្រូវ​បាន​​មេ​ដឹក​នាំ​គណបក្ស​ប្រឆាំង​រូប​នេះ លើក​ឡើង​ថា គឺ​មាន​តែ​មួយ​គត់​នោះ​គឺ​ការ​ប្ដឹង​ទៅ​ក្រុម​ប្រឹក្សា​សន្និសីទ ​ទី​ក្រុង​ប៉ារីស ស្ដី​ពី​​កម្ពុជា​ឆ្នាំ១៩៩១​តែ​រដ្ឋាភិបាល​បច្ចុប្បន្ន ទុក​យួន​ជាធំ ខ្លាច​ប៉ះពាល់​ផល​ប្រយោជន៍​យួន៕

He is absolutely corrected; I am not a big fan of SRP but in this case he is right. Cambodia didnt ask ICJ to create DMZ but it did any way and it was surprised by both countries. The next step is to interpret 1962 ruling. What else ICJ has under it sleeves? I am doubtful that Cambodia gain from the ICJ past ruling but if the government seen it differently, I will trust them to handle things. I am sure that they care and love Cambodia the same way as SRP. We all should speak one voice and help each other to ensure that we dont loose out. The ruling party should be opened to opposition suggestions because it might seen things differently. Dont leave any stone unturned. Opposition has the same rights as other ordinary citizens to offer suggestions. Thailand continues it verbal attack and Cambodia hasn't response much.

Sam Rainsy is correct. ICJ did not stand by who is right and who is wrong, but rather trying to play a peace keeping role. In the future, if Thailand decides to fight for another part of Cambodia, it likely will happen, the ICJ will continue do the same peace keeper.

Cambodia is beginning to rebuild its arm force to challenge Thailand. In this situation, the relationship between the two countries will likely getting worse, not better. I believe by the year 2020, the Cambodian military will reach some where around a quarter of a million troops. The continue clash between the two nations absolutely will happen again and again.

Cambodia is the rightful owner of Preah Vihear temple and there has been a clear recognition from the ICJ in 1962. No one says the contrary and actually this is the real cause of the war so far. We wouldn’t fight for a land that doesn’t belong to us. Yes, even Thailand repeated several time that they recognized the 1992 ICJ ruling and they always say so that Cambodia owns the Preah Vihear temple. But the war which engulfed that region was not originated from the temple itself, but the vicinities, or the land around the temple claimed by both countries, Cambodia and Thailand. People who live on both sides of the border need to live without fears of being killed or seeking refuges in other places far from their own villages. Living in peace is in fact a basic human right. More than that, if the ICJ were to order only Thailand to unilaterally withdraw its army from those vicinities of the temple that measure could be interpreted as de facto recognition of Cambodia’s ownership of the land surrounding the temple. In that case, there would be no need of further ruling or interpretation of the 1962 verdict as requested by Cambodia. That may not need the provisional demilitarized zone, or the ASEAN observers at the place, etc. Thailand may see it as a blame the ICJ squarely put on them in this war. I think that the 17 international judges of the ICJ are a lot wiser than Mr. Sam Rainsy and a lot more knowledgeable than the leader of the opposition’s party in protecting the civilians along the border. Please be a bit more patient, with the final ruling in a few months from now, Cambodia will be able to recover everything, the temple and the land around it and a border of peace and stability.

In 1962 the ICJ order Thailand to withdraw troops and polices from the Preah Vihear Temple and the temple's vicinities. Maybe you need to reread the 1962 verdict again. Sam Rainsy is corrected and you are wrong.

I don't think you have to wait until 2020 to see Cambodian forces reach a quarter of a million men and women. I think it's going to be a lot sooner given the circumstances surrounding the ICJ decision. Our people are smart and learned from past mistakes. I know we need to improve our economy and reduce poverty. However, the clear and present danger are the 2 neigbhors, Thailand and Vietnam. We have to simultaneusly focus on the economy and at the same time modernize our military.
Besides, the economy are run by private investments and free market anyway. The government will need to provide the stability and infrastructure to foster that market. That leaves them some resources for our military.
Don't get me wrong. I want peace, so far no one has unanimously supporting us regarding PV and the border. We have to be strong and wise and tactful. Once we have strong military, no one will want to challenge us.
I truly believe that by 2013, our government will be able to priortize the budget better because by that time, oil revenue will be realized and somewhat pumped into the budget. I am very optimistic about the outlook. Just be a little patience, we will be strong again.

look at this icj remove the Thai thief from the khmer house and also ask khmer who own the house to move too?
Because icj known that if khmer don't move out the Thai thief will come to burn khmer house for sure
the world known that thai is very tricky people(German known that very well)

I agree 100% that in 1962 the ICJ ordered Thailand to withdraw troops and polices from the Preah Vihear Temple and the temple's vicinities.
The problem is that Thailand looked at different map and claimed the 4.6 skm. The reason why there was war so far. The Thais didn't use the 1904-1907 map and withdrawn its army. That is why we go back to the ICJ for interpretation of the 1962 ruling. Do you want to keep having war with Thailand and destry people lives over there. You may be happy to know that the Yello Shirts and Abbhisit think the same as you and Rainsy!

Sam Rainsy is correct to be upset about this case,but there is no other way. In the court procedure this is the first step of the judges and the juries to find out,which side is guilty.Criminal is remain innocent until it is proved guilty.

As the matter of fact it is the ruling gov.CPP that is to be blamed for giving status to the Thai thief by allowing them to have so many bilateral negotiations and especially seeking for the endorsement from Thailand before their invasion.
My pint is,if you believe that PV. and the 4.6 km2 is in Cambodia why you need Thai's endorsement to put PV. as a world heritage site. Why did Hun sent SOk Ang to seek for that endorsement in 2008?. This is the incompetence of Hun's and his clans decision.

I have strong faith with the ICJ that the DMZ is a clever measure to stop two nations fighting each other.
The most important thing for the ICJ looking for is the facts and figures of history behind the PV. and the relevances of papers that both countries signed and agreed in the past.For Thai side this important evidences is just simply don't add up to prove that PV. and the 4.6 is belong to them.


There is no U-TURN from now on,but let the ICJ to proceed this case and hope that justice is given to Cambodia.

I think Rainsy did a good job here. To ask Cambodia to withdraw troops from its territory is like asking the owner of the house to leave his house. Thailand is the thief, therefore the ICJ should only ask Thailand to withdraw troops, not Cambodia.
