Cambodia’s Government Fully Supported ICJ’s Order in Hague for Preah Vihear Temple Area of Peace

AKP Phnom Penh, July 19, 2011 —Cambodia’s Royal Government has fully supported the Order of the International Court of Justice (ICJ) in Hague in response to the request of Cambodia that wants peace in Preah Vihear Temple area.

Here is an unofficial-translated statement issued by Cambodia’s Royal Government on July 18 and seen by www.mfaic.gov.kh website.

Acting on the request of the Royal Government of Cambodia for provisional measures prior to the interpretation of the Judgment of 15 June 1962 in the Case concerning the Temple of Preah Vihear, the International Court of Justice at the Hague decided on 18 July 2011 as follows:

A. The Court unanimously rejected the Kingdom of Thailand’s request for the case
introduced by Cambodia on 28 April 2011 to be removed from the General List.

B. The Court decided:
1. By eleven votes to five,
Both Parties shall immediately withdraw their military personnel currently present in the provisional demilitarized zone, as defined in paragraph 62 of the present Order, and refrain from any military presence within that zone and from any armed activity directed at that zone;

2. By fifteen votes to one,
Thailand shall not obstruct Cambodia’s free access to the Temple of Preah Vihear or Cambodia’s provision of fresh supplies to its non-military personnel in the Temple;

3. By fifteen votes to one,
Both Parties shall continue the co-operation which they have entered into within ASEAN and, in particular, allow the observers appointed by that organization to have access to the provisional demilitarized zone; and
4. By fifteen votes to one,
Both Parties shall refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve.

C. By fifteen votes to one,
Decides that each Party shall inform the Court as to its compliance with the above provisional measures;
D. By fifteen votes to one,
Decides that, until the Courts has rendered its judgment on the request for interpretation, it shall remain seized of the matters which form the subject of this Order.

The Royal Government of Cambodia fully supports the Order of the International Court of Justice, which is completely responsive to the request of Cambodia that wants peace in the area of the Temple of Preah Vihear, the observers to be stationed in the provisional demilitarized zone and the continuation of normal civilian activities.

The Royal Government of Cambodia hopes that the Thai Royal Government will accept and comply with the above-mentioned correct decisions of the International Court Justice.

The Royal Government of Cambodia calls for the Indonesian observers, as agreed by all ten ASEAN members and as per the decision of the International Court of Justice, to carry out their mission as soon as possible in the provisional demilitarized zone. Cambodia is ready to welcome and provide all facilities necessary for the mission of these observers.

The Royal Government of Cambodia expresses its sincere thanks and high appreciation to the Cambodian delegation led by His Excellency Hor Namhong Deputy Prime Minister and Minister of Foreign Affairs and International Cooperation, for their strenuous efforts and brilliant success brought to the Cambodian nation.

I appreciated point by point of the ruling. We may not know what is ICJ agenda but it is clear that ICJ wanted to avoid more clashes which is understandable. By creating DMZ without time frame when the final ruling or will there be final ruling at all could potentially setup for both countries to fight generations after. I must say, after reviewing the ruling, Cambodia doesnt have much option except to comply with the order and must work hard to dig it ways to victory in the future, I hope. I would encourage the government to look into long term future conflicts if this issue doesnt resolved clear cut. In my oppinion of the ruling, Cambodia has the Temple but Thailand has the stair/latter. In order to access the temple, you need the walk way to get into the temple as indicated by Thailand to inspect Cambodian personnel from access the DMZ. Cambodia needed to be cautious with any talk as Thailand taking initiative to resolve the issue which is out of Thailand character. Thailand will want to shift the gear into bilateral talk as it wanted from the beginning but Cambodia cannot trust Thailand that why Cambodia needed to stick with 3rd parties involvement in any talks to implement the withdraw and it should be in writing so that you can have evidence to report back to the ICJ. The other sticking point that Cambodia need to be on alert is that Thailand will try to shift the talk to GBC to implement the order from the court. I am not saying the GBC from Cambodia side is weak but there are tecnicality of details regarding implementation or the withdrawal troops; I would urge that Cambodia do not make any decision without groups consultation and approval from PM Hun Sen. Remember GBC was not the one involve in the court proceeding therefore their knowledge is limited eventhough information being shared with all the teams, I assumed. Cambodia should take the initiative rather then waiting for Thailand to call the agenda for talk to resolve/implement the court order. Cambodia should show Thailand who is in charge. Come with prepared agenda rather then response to Thailand agenda. This way you have time to think what you really wanted and how you wanted it and ask Thailand to provide you with their agenda ahead of time. I dont mean to give advise or carry away with my comment. I am sure the government has many great advisors. What can I say, I am Khmer and I love Khmer.
