Mrs. Mu Sochua's lawyer might face penalty

Translated by Khmerization

A lawyer for Mrs. Mu Sochua, Mr. Kong Sam Onn, might face fines or suspension of his licence to open the way for the court to take legal procedures against him, if the Bar Association of Cambodia found that he had committed misconduct as alleged by Mr. Hun Sen's lawyer.

Mr. Kong Sam Onn held a press conference with Mrs. Mu Sochua in which they threatened to sue Mr. Hun Sen for defamation he made in his speech a few weeks earlier. Mr. Hun Sen then sued them both for defamation made during their press conference.

Mr. Ky Tech, former president of the Bar Association of Cambodia and the lawyer representing Mr. Hun Sen, has lodged a complaint to the Bar Association, requesting it to investigate Mr. Kong Sam Onn's conduct and his statements during the press conference on 23rd April and his subsequent interviews with the media.

Mr. Chiv Song Hak, current president of the Bar Association, said he did not know about the complaint against Mr. Kong Sam Onn yet. But Mr. Ky Tech said that the complaint had been lodged with the Bar Association since 30th April.

Because both have parliamentary immunity, both needed to be stripped off their parliamentary immunity first before court can proceed with their case. So, if parliament wants to lift Mu Sochua's immunity, Hun Sen's immunity has to be lifted as well so that the court can proceed with the suit against him. If only Mu Sochua's immunity is lifted then it means that court cannot take action against Hun Sen, so it means that Hun Sen is above the laws.

Well, it is people like Hun Sen (Sihanouk) that forced people to take up arms in the 1960s and 70s. When legitimate political opinions are not tolerated, people will resort to arms. Hun Sen is forcing to people to go underground because their legitimate opinions in the open are suppressed with force and by using court as his (hun Sen's) tool.
