A parliamentary source said that the Cambodian National Assembly is awaiting for a letter from the court requesting it to lift Mrs Mu Sochua's parliamentary immunity, reports Radio Free Asia.
Mr. Cheam Yeap, chairman of the 5th parliamentary committee, said: "The court has not yet sent any legal request to the parliament."
Mr. Hun Sen and Mrs. Mu Sochua (pictured) sued and counter-sued each other for defamation. Prime Minister Hun Sen, whose party controls more than 2/3 majority in the parliament threatened to strip Mrs. Mu Sochua off her parliamentary immunity, a threat that was condemned by local and international human right advocates.
Mr. Ya Navuth, chairman of the local NGO, CARAM, said: "To open the way for the court to properly investigate the case, if there is a need to lift the parliamentary immunity, both of them should be stripped of their parliamentary immunity."
Mr. Kong Sam Onn, lawyer for Mrs. Mu Sochua, concurred. He said: "But if he (Hun Sen) said that (he cannot be stripped off his parliamentary immunity) because the ruling party has the majority in the parliament. This means that even if the prime minister did something wrong no one can touch him. If this is so, how can we implement the laws?"
Mr. Hun Sen said because his party controls more than 2/3 majority in the parliament, he doesn't believe that the parliament will strip him off his parliamentary immunity.
