Sam Rainsy called for the indictment of the CPP leaders on the 36th anniversary of the Khmer Rouge takeover

The exiled opposition leader, Mr. Sam Rainsy, has called on the Khmer Rouge Tribunal to indict the current leaders of the ruling Cambodian People's Party (CPP) on the 36th anniversary of the Khmer Rouge takeover power on 17th April, 1975.

Exactly three years ago, he made a controversial speech accusing Foreign Minister Hor Namhong of being complicit in the Khmer Rouge genocidal crimes which landed him in political hot water and legal tussle that could see the end of his political life.

During a videoconference with 100 supporters on the 36th anniversary of the Khmer Rouge takeover, Mr. Sam Rainsy said that the indictment of only five ex-Khmer Rouge leaders is not enough. "The neo-Khmer Rouge, like the Chea Sim clique, the Hun Sen clique and the Heng Samrin clique used to celebrate the 17th April day because they consider it as their victory day. It means that these people were Khmer Rouge who had killed their own Khmer people. They are criminals who must be brought to justice at the International Criminal Court", he said.

However, Mr. Dim Sovannarom, spokesman for the Khmer Rouge Tribunal, said the Tribunal cannot go beyond the mandate and the jurisdiction provided under the agreements reached between the UN and the Cambodian government that only allow the indictment of five Khmer Rouge leaders only. "The mission of this Tribunal is to seek justice for all the victims. And the most important point is whatever work we are doing, we must based it on the laws, based on the agreements and based on the prescribed laws", he said

Many of the current leaders are ex-Khmer Rouge senior officials , like Chea Sim, Hun Sen and Heng Samrin were ex-Khmer Rouge military commanders. Hor Namhong was chief of Boeng Trobek Detention Centre, Finance Minister Keat Chhon was Pol Pot's advisor, Defence Minister Tea Banh was also one of the Khmer Rouge military commanders.

According to the Washington Post, Heng Samrin's and Hun Sen's troops had threwn grenades into a hospital and slit the throats of critically ill patients when they overrun a hospital in Kampong Cham in 1973. "When overrunning two hospitals, Heng Samrin's and Hun Sen's troops threw hand grenades and later slit the throats of critically ill patients", said the Washington Post.

Elizabeth Becker, a journalist who wrote an excellent book on Cambodian civil war "When the War was Over", also made similar claims in the International Herald Tribune: "Several soldiers and residents told the photographer that some of the rebels threw hand grenades and plastic explosives into still-occupied homes and cut the throats of the critically wounded at the city hospital", she wrote.

The Khmer Rouge Tribunal will not dare to indict the current leaders of the ruling Cambodian People's Party (CPP)at all.

The court presence in Cambodia is at their mercy of the CPP. If the court declares its intention to indict the big three bosses, then the court had better get ready to leave Cambodia because it will be certainly kicked out of Cambodia very fast by the three powerful Samdachs.

Justice in Cambodia is simply a game and it will never be total justice and everyone knows that.

Try suggesting bringing Sihanouk, the King Father to the court and you will know what I mean.

I think Sam Rainsy is out of options!

Cambodians are funny people and you may have to be flexible like Sihanouk to survive the Cambodian politics. Loving your country, Cambodia and working for the people are not good enough to get total support from the very people you are trying to help; you need to a crook to some extent to survive Cambodian politics, which is too bad.

I haven't seen any media outlet asked question about sam rainsy motive in the issue of called on the Khmer Rouge Tribunal to indict the current leaders of the ruling Cambodian People's Party (CPP) on the the ground of they're ex-Khmer rouge it mean every Khmer should stand try it look like the big chunk of the Khmer population must stand try as the ex-Khmer rouge .
Sam rainsy educated in france he should known better in the system of law any indictment must have the evident of crimes have been commit question should be asked did the (CPP) commit any crimes during the Khmer rouge regimes ?.
Any wrongly accusation it a crimes too that why sam rainsy face too many law suites in the democratic world every body have the same right he should not infringe the right of other.
If joining khmer rouge is a crime and abandon (deserted) your country during the killing field is a crime too sam rainsy cannot making baloney to a big issues this is telling how desperate the man is like father like son ,at least if not to the most (CPP) stop the killing field sam rainsy like it or not its the fact that can't over look.
Hun sen and CPP is not perfect the issues have to be address but not with Khmer Rouge Tribunal it seem sam rainy is in the confuse state of mind cannot know right from wrong his English is quite poor and he should be careful with his dialogue .
He can make clown all he wants but the reality is how many people are belief him before he run out of gas and no one to talk to.

Surely the Khmer Rouge Tribunal will not dare to indict the current CPP leaders. But what Rainsy has done is to remind the world that the current Cambodian leaders were ex-Khmer Rouge officials who had Khmer blood on their hands. When the world is convinced that they had blood on their hands, maybe the international criminal court might investigate their crimes in the future, maybe. The current Khmer Rouge Tribunal has found nothing new. Every details or evidences are old material. As such, to spend over 100 million dollars to just indict 5 people with old evidences is a waste of money and an insult to the soul of the victims. These 5 KR leaders could have been tried in the normal Cambodian court, using the same old proof and evidences and it only cost peanut and will get the same justice. To spend over $100 million, more criminals, like the current leaders of the Cambodian People's Party, should also be brought to justice.

Those 5 CPP are just the small fish in the Khmer rouge regimes Tea bunh is just Lieutenant colonel and hardly survive he face the Lon Nol firing squat 1970 and 1973 he almost kill by Pol Pot he has to escape to Thailand .
A lot of people doesn't know what they talking how Hun Sen end up in vietnam? these people are barely survive.
I am not an Ex-Khmer rouge to be clear I've been lock up by Khmer rouge twice for minor stealing all my family are almost wipe out but i've to divide the tree from the forest.

Hun Sen did not escape to Vietnam in 1977 because he hated the Khmer Rouge or wanted to save Khmer lives from the Khmer Rouge. Hun Sen, Chea Sim, Heng Samrin etc, escaped to Vietnam because they afraid they would be killed by Pol Pot after being accused of being the traitors for helping Vietnam to attack Cambodia. Hun Sen, Chea Sim and Heng Samrin were senior KR commanders in the Eastern Zone where most of the killings and executions had taken place. It meant Hun Sen, Chea Sim and Heng Samrin had killed more Khmers than in any other zones in Cambodia during that time.
