Mu Sochua's lawsuit against PM Hun Sen dismissed by Phnom Penh Court

Mrs. Mu Sochua said the dismissal of her lawsuit against PM Hun Sen is a bad precedent, but she has not indicated whether she will lodge an appeal against the decision of the Phnom Penh Court, reports Radio Free Asia.

She said: "I noticed that yesterday, the court had just interviewed Prime Minister Hun Sen. I just want to know how did the court investigate (his case against me) and did it interview any witnesses? All of these must be revealed to both sides before the court dismissed my case."

On the morning of 10th June, Mr. Heng Bun Chea, the Phnom Penh Court prosecutor, sent a letter to Mrs. Mu Sochua's lawyer informing him that his client's lawsuit lodged against PM Hun Sen lodged on 27th May had been dismissed, but did not elaborate on what grounds the case was didmissed.

The officials from the Phnom Penh Court cannot be contacted for comments regarding the letter.


Mr. Kong Sam Onn, Mrs. Mu Sochua's lawyer, said that according to judicial procedures, his client can appeal the decision, but he said the decision whether to appeal has not been made yet.

However, Prime Minister's lawsuit against Mrs. Mu Sochua will be proceeded as normal. Mr. Ky Teck, Mr. Hun Sen's lawyer, said: "Prime Minister Hun Sen's lawsuit against Mrs. Mu Sochua is still proceeding as normal. At the moment, we don't know the result yet because the court is still doing its works."

Human right groups said the court's decision to dismissed Mrs. Sochua's case against Prime Minister Hun Sen shows that the court is still not independent.

Mr. Ny Chakrya, investigator for Adhoc, said: "This is the problem that makes people see that the courts are still not independent in implementing its judicial procedures."

Mrs. Mu Sochua sued Prime Minister Hun Sen for defamation when he publicly said " There is a female cheung klang (strong leg) who is good at making troubles who lunged to hug someone and accused that person of unbuttoning her blouse."

Mrs. Mu Sochua said Mr. Hun Sen took a swipe at her and she took offense of the phrase because she said the term 'cheung klang' is very offensive to women.

Everybody knows. The courts in Cambodia are not real courts. They are political tools to serve the interests of the ruling party, especially Hun Sen's interests.
