Parliamentary Immunity: A message of support to Mrs. Mu Sochua

Dear Mrs Mu Sochua,

I am fully supporting your case and your stance for your justice.

In correct procedure of the court, the court should send your affidavit to the Prime Minister for his defense of defamation. The Prime Minister cannot lodge a court case against you while your complaint has already in the court. Until he can be cleared that he has not defamed you by the court then he can lodge a counter-suit for his damage.

In advanced society, the Prime Minister cannot sue you for his damage at all because both you and him are all politicians. He has not suffered any damages from your lawsuit. You have demanded from him for only 500 Riels (~$0.15). He is still the Prime Minister of Cambodia. He still earn his salary. Therefore if you are lost this court case, the most you have to pay him is his court cost.

Refering to your immunity, you have got it automatically from National election which has involved with the people of the entire Nation. Therefore no one or no group can lift your immunity at all. Your immunity can be lifted only if you have committed a criminal act such as you have killed someone or has stolen a big sum of public moneys.

I believe very strongly that any attempt to remove immunity from member of opposition party member is an attempt for a coup d'etat against Democracy system and to create fears and threads against freedom of citizen which has been written in the constitution.

I must also remind everyone that in a democratic parliament with multi-political parties election like Cambodia, The King is the first Head of state, The Prime Minister is the second statesman and the main opposition party leader such as Honourable Sam Rainsy is the third Statesman. They equally deserve to have the same respect and the same level of protection from the national security agencies.

Each party must have their budget given to them by the parliament and was distributed according the number of seats held by each party. The main opposition party leader deserves his salary higher than any member of the minister of the government.

At the end, I wish you with good health and good success in serving our Nation.
