Khieu Samphan wants to be released on bail

PHNOM PENH (The Cambodia Herald) -- Former Khmer Rouge leader Khieu Samphan, 81, asked for the UN-backed war crimes tribunal to release him on bail.

Speaking in Thursday's hearing, the head of state for the K.R. regime, said he didn’t have any passport, and just wanted to live in a flat with his wife and children.

Khieu Samphan, who has denied charges of war crimes, genocide and crimes against humanity, also promised to respect the court’s laws and would appear in court if he was called back.

His Defense Counselor, Arthur Vercken, also appealed to the court to release the 81 year-old, but he would be under court observation.

The appeal was made when Arthur Vercken said, his client has been detained for five years and four months without receiving a final trial over Case 002.

If he was to be released on bail, Khieu Samphan would not move without informing the court, Arthur Vercken said, adding that his client would not contact any reporters and it would be clear that the release would not lead to escape.

However, co-prosecutors rejected the appeal and demanded the detention has to be upheld to keep social order and safety for the suspect, to avoid violence which could happen if he was to be released.

The Khmer Rouge Tribunal will decide whether or not to release him within the up-coming day.

Khieu Samphan was detained on November 19, 2007, and later filed a complaint against the decision and called for his release, the court rejected his request.
