I agree with the US Embassy's confidential cable, attached, that Mr. Sam Rainsy did not pull the boundary stakes as he has been accused and convicted by Samdech Hun Sen's Court. There is no evidence whatsoever that Sam Rainsy even touched the boundary stakes before or after they were pulled up. TB

(SBU) In both the prelude to the hearing and the reaction to the verdict, the SRP appeared uninterested in addressing the actual charges of Rainsy's role in property destruction and incitement, and instead focused on the larger issue of whether the border markers are improperly placed (Ref B). Rainsy continues to claim sole responsibility for the removal of the temporary border markers, despite video showing he did not physically uproot them but brandished them for the cameras after others had pulled them up (Ref A).
With the January 27 verdict, Rainsy cannot return to Cambodia unless he goes to prison or receives a pardon, which requires agreement of the government. In the meantime, without a
leader present in Cambodia able to project a confident image and articulate opposition perspectives, the SRP faces tough decisions about what to do next and the ultimate direction of
their party. In the end, most find it difficult to imagine how Rainsy's stunt will increase the SRP's political relevance in Cambodia, despite the headlines it attracted by Rainsy's very visible and vocal efforts to mobilize anti-Vietnam passion while most of Cambodia's population was focused on Thai border issues. However the SRP emerges from this incident, it is clear that -- at least for now -- the playing field for opposition politics has been reduced as a
result.

Why he never denied that he didnt pull those poll? He didnt say anything accept to admit it so that he gain political popularity. I guess it back fire on him. This is true about Sam Rainsy character in the book of "Cambodia Curses"
How could he possibly pull those poll if he was on cell phone in the middle of the rice field? It was a dog and pony show for political popularity. He could have cleared his name easily if wanted it to; all he has to do was denied it and attend the court. May be he doesnt want his people to take the wrap for him. Sound pretty noble man, unfortunately those peoples are sitting in jail right now. Sam Rainsy didnt do anything to clear their name or clear his name either. This is part of Sam Rainsy tactics no matter how many people sit in jail or how dirty the trick is. He willing to play victim to gain sympathy and the stupid people didnt realize it either. Sam Rainsy is the master of manipulation. Imagine if he become Prime Minister.
So what is the purpose of the court and court investigation? isn't it to find the truth and justice? Now,if SR did not pull/destroy the markers he should be cleared of the old charge.The catch is he has to face a new charge of obstructing justice which should ban him from participate in the up coming election. You can not trust this guy with such type of tricks!
Have him admit his bad intention and make apology to the whole Khmer nation for his causing the disturbance first then let him come home but stay away from politics for the next 5 years.
I agreed with the commentors. The question, why Sam Rainsy didn't deny that he was not the one that pulled the pole since the people that did it now serving time already? Sam Rainsy plays victim to gain political benefit back fire. It hurt him since he can't return. I noticed that he was on his cell phone pretending to pull the pole. Technically, he should be able to return home. Do you think Sam Rainsy wanted to return at this time? I think he is enjoying his time fighting from outside using media such as RFA and other outlet that favor Sam Rainsy. Mu Sochua should represent the party and have her run for Prime Minister upcoming election. There is no way that Sam Rainsy can beat PM Hun Sen. CPP knows Sam Rainsy amo already.
Whether He denies or not, it makes no difference what-so-ever. His targets are CCP members, not the pieces of woods. His goal is to show that Cambodia is giving land to Vietnam. Let not focus on those pieces of woods. If he pulled them, he could put them back. Those pieces of woods did not mean anything at all, but the symbolic of it that make the government tick off (furious).
Sam Rainsy must know that he was pouring gasoline on fire, and he know that he going to make some one furious. This is his intention, but what he did not know is that the government was jumping the gun by defining some people for incarceration.
The purpose of the government is to get rid of Sam Rainsy. The government think that he is a trouble maker.
If the evidence show that Rainsy did not uproot the border stakes then the court should exonerate Rainsy of all charges, clear his name then allow him to return home free of all charges. The fact that all the courts, from appeal court to high court upheld the sentence, means that it is a political charge because the courts just convict Rainsy by following order from Hun Sen, not based on legal argument and evidences. This is a kangaroo court.
Rainsy tried to protect Khmer territory, but the traitorous court and government of Hun sen tried to persecute him. How sad.
