Cambodia must be wrong to claim her own property?

Siam, later known as Thailand, came into existence and grew to its present day Thailand on former Khmer empire which lost its western provinces to advancing Siamese army. As a result, successive Khmer kings paid a vassal tribute to Bangkok until France came to exercise its protectorate over Cambodia from 1863 to 1953. France then started to negotiate with Siam for a definite border demarcation and delimitation between France's Indochina and Siam, and both had concluded a number of conventions and treaties (1904 and 1907) and many others. With regard to Cambodia, a Franco-Siamese border commission produced clearly marked maps and planted a number of border posts. In the process, three Cambodian provinces in north-north west were returned to Cambodia in exchange for a few Cambodian provinces, namely Trat, Chantaburi etc, in the south sea border were given to Thailand.

This part of history has been put in the dark so as to arouse Thai irredentist claims that all the territory west of the Mekong were Thai and Thailand were forced by France to unduly give a lot of Thai territory to Cambodia. The truth is, and remains that, it was Cambodia which had lost a great deal of land to Thailand. Yet Cambodia, a law abiding country, never claimed them back from Thailand, nor initiated any conflict with her neighbor. Then, in 1941, taking advantage of World War II with Japan’s occupation of French Indochina, Thailand annexed the western Cambodian provinces of Battambang, Siem Reap, Kompong Thom, but was forced to return them back to Cambodia under the Washington Treaty in 1946.

As if a prey had been taken away from its grip, all the Thai myth of land ownership has been building up to justify Thailand’s military occupation of some Cambodian lands, in particular the temple of Preah Vihear and its surrounding in 1954, soon after Cambodia acceded to independence in 1953. After years of unfruitful negotiations, Cambodia, under Prince Norodom Sihanouk, brought the case to The Hague International Court of Justice (ICJ) which rendered a verdict on 15 June 1962 in favor of Cambodia. The ICJ verdict was crystal clear when it referred to the Franco-Siamese treaties and border maps produced by Franco-Siamese Border Commission used ever since by both parties, as valid and legal international documents. Most importantly, and Thailand cannot deny it, was a “Dangrek Map”, known as “Annex 1”, which formed part of the 1962 ICJ decision. This “Annex 1” map is to this day crystal clear over the border lines between Thailand and Cambodia. Only Thai extremists, who become so obsessive and mad about Thai loss at the ICJ, who keep repeating until this day that the 1962 ICJ ruling recognized that only the temple belonged to Cambodia and not the ground surrounding it. Any honest person needs no doctorate degrees to appreciate the well-explained ICJ decision.

At the same period that the Thais had secretly produced their own map, drawn on the US war maps, intended to replace the “Annex 1” map, with a new border line showing the so-called 4.6km2 parcel of land surrounding Preah Vihear temple they claimed, as not a “contested area”, but as Thai territory, in flagrant violation of the 1962 ICJ verdict, a rarity in modern day world. This fact alone, and for the fact that they have used an illegal and unilateral map, is a violation of international laws and which constitutes an act of aggression and a casus belli.

Armed with this illegal map, the Thai irredentist ultra-nationalist group started to brainwash their fellow citizens, including young generation of scholars and to fool foreign governments, that Cambodia was encroaching on Thai territory. For instance, their representatives went around, with this illegal map, to fool UNESCO members when Preah Vihear temple was on the agenda of the World Heritage list. Obviously, their fabrication did not hold water and World Heritage Committee members just ignored it and unanimously approved the listing in 2008, thus reconfirming the 1962 ICJ decision in favor of Cambodia.

Many Thai irredentist groups, probably for their political survival, and to a certain extent for their own political interests, started to act like outlaws against the whole world and to started to provoke military conflicts with Cambodia, accusing Cambodia of having started the war! Bangkok media picked it up to fool the public that Phnom Penh started this war for political and election purposes. It must be the other way around when, in 2008, Bangkok was under street protests from both yellow and red shirts that paralyzed business and airports operations for a few weeks. Honest people cannot accept such a misleading story from the aggressor. But some biased and irresponsible media likes also to entertain this myth when, with an air of superiority, they belittled the temple as a “tiny, crumbling, 11th century-old ruins” claimed by both countries. UNESCO must then be wrong to list it as one of the World Heritage sites, and Cambodia must be wrong to claim it as her own property? Of course, the above is just a very condensed story showing how some bright people in Bangkok born with some inferiority complex, culturally speaking, spent their life to enlighten themselves by manipulating and distorting well known facts and history so as to demonize Cambodia and her past and present leaders.

Mr Sothirak then provided a Cambodian perspective initially from an historical and judicial perspective of the Temple, the border dispute itself, the “root cause” leading to the present conflict, and finally the impact on ASEAN and a possible solution. He gave a historical background of the Temple, right up until 1962 when the International Court of Justice (ICJ) ruled that the Temple belonged to Cambodia. He elaborated that the 805 km. border was marked by boundary stones resulting from the Franco-Thai convention of 1904, which resulted in maps including the 1908 “Dangrek Map”. How Thai lost the case at ICJ

The Court sees the matter differently. It is clear from the record that the publication and communication of the eleven maps referred to earlier, including the Annex 1 map, was something of an occasion. This was no mere interchange between the French and Siamese Governments, though, even if it had been, it could have sufficed in law. On the contrary, the maps were given wide publicity in all technically interested quarters by being also communicated to the leading geographical societies in important countries, and to other circles regionally interested; to the Siamese legations accredited to the British, German, Russian and United States Governments; and to all the members of the Mixed Commission, French and Siamese. The full original distribution consisted of about one hundred and sixty sets of eleven maps each. Fifty sets of this distribution were allocated to the Siamese Government. That the Annex 1 map was communicated as purporting to represent the outcome of the work of delimitation is clear from the letter from the Siamese Minister in Paris to the Minister of Foreign Affairs in Bangkok, dated 20 August 1908, in which he said that "regarding the Mixed Commission of Delimitation of the frontiers and the Siamese Commissioners' request that the French Commissioners prepare maps of various frontiers, the French Commissioners have now finished their work". He added that a series of maps had been brought to him in order that he might forward them to the Siamese Minister of Foreign Affairs. He went on to give a list of the eleven maps, including the map of the Dangrek region - fifty sheets of each. He ended by saying that he was keeping two sheets of each map for his Legation and was sending one sheet of each to the Legations in London, Berlin, Russia and the United States of America.

If Thai government thinks that Cambodia is a small country and military is weaken then them, just let them tried. I suggest that if Thai continue to brake to the law, Cambodia would rather toward to Bangkok and take the land back. I believe that the central land of Thai is belong to Cambodia.

if we want to claim Kampuchea krom land back from Vietnamese communist. First, the Country of Cambodia must be strong of Economy, so every individual has a job and live a better life. second, to build more school, so young generation will get a better Education. Third, the Cambodia Government must be encouraging the world to do the business in Cambodia as many as they could. However, Cambodia must be accepted to any aid (assistance) from any country; especially the United States and China. at the same time, the Cambodia Government must be created of the military strength(power). I mean, whatever we plan, we must think about ourselves first. Therefore, we must confident that we have enough power defeat the enemies, then we will do it. If not, we'd better keep silent for a moment. Think about it! anyone on this Earth has the same things isn't it? bone, blood, and meat.(hihihi) if you think that you're a smarter, stronger, and braver, then you're the winner. That's it! it's easy to understand the situation, right? actually, I'm the one of Khmer krom, but fortunately I came the U.S. just a few years after the Vietnamese Communist took over our land (kampuchea krom) (South Vietnam) I hope one day in the future, I will help the Cambodia Government to claim the land we had lost.

Hello Mr. PM Hun Sen and Khmer brothers and sisters. I’m one of Khmers krom, but I’m not living in Cambodia either in Kampuchea krom. Actually, I came to the United States for thirty years ago. I’m writing this letter to you PM Hun Sen because I have been admiring and supporting you from the bottom of my heart. Compared to a several previous generation, you are a good leader. However, I’m sure that you might-have-been remembered what happened before 1970 when the King of Sihanouk was a chairman at the time. I didn’t mean to make him feel bad about what he did, but I just can’t keep it in my heart forever. Sihanouk mess up the country because he fed alligator (HoChiMinh); he himself also knew what he did. In the last few decades, Cambodia had lost so much land just because of the Khmer Empire. Thai, Vietnamese communist, and Lao tried to take advantage of Khmers King kindness, and stool our land. Now is the 21st Century, the young will not repeat the mistake that the old generation had made in the past. My understanding is, Cambodia government will be allowed to all foreigners who want to live in Cambodia, but they must follow the rule of Government just like other Khmer citizens. Here are several rules that they must be following: 1) they must learn the language, 2) they must be able to fill out of the legal documents, 3) they must joint army and serve just like other Khmers do, 4) if they act against the government then they will sentence to prison for life or death penalty, 4) all of the government documents must be Khmers and English languages only.
I had proved and seen in my own eyes that Yuon Hanoi and Thieu’s regime alleged that they wanted Khmers krom to die, so they were always put Khmers krom in front-line just like Thai did to Khmers Surin. I felt sad and sick in my stomach when I saw Khmers died in irrational way. This is not funny to Cambodian people at all. This is a serious matter that Khmers leader should pay a closer attention. Khmers young generation can do better but depend on a leader. My understanding is the Education department of Cambodia must create the flyers and small books, and the comment will be written a brief explanation about the history of Cambodian people and original Geography. It can help Khmers Phnom Pen, Khmers Surin, and Khmers Krom to understand more about Cambodian people and Geography. On the other hand, the Cambodia Government must drop the flyers all over the provinces where the Khmers Surin are living. Therefore, Cambodia Government must show them respect, welcome, and promise that we were born in the same blood and language. God of Buddhism will bless and bring Khmers Phnom Pen, Khmers Surin, and Khmers Krom together in one Nation and united. I believe that Khmers will defeat the enemies because Khmers are tall, strong, brave, confident, and well trained. God knows Khmers can do it. So please, think about it twice. Ladies and Gentlemen, Khmers have right to claim our land back if it possible. I'm sure that Yuon Hanoi never return it to us. However, the world have known since the France gave it to Vietnamese on June 6, 1949, "Illegally, without permission." Now China back up Cambodia's economic growth and military strength, so I hope that one day we will have enough power, and then we must use military action over the Vietcong.
