The Election Commission will have to await the Cambodian verdict before it can rule on the job status of Democrat MP Panich Vikitsreth detained in Phnom Penh, EC secretary general Suthiphon Thaveechaiyagarn said on Tuesday.
Panich and six Thais are facing immigration charges in connection with their arrest last month in Banteay Meanchey, opposite Sa Kaeo's Khok Sung district.
"As I understand it the Cambodian judicial process in forming a verdict will be lengthy," Suthiphon said.
The EC is checking with the Ministry of Foreign Affairs to monitor the outcome of the judicial decision, he said.
Under the Constitution, a convicted MP is disqualified to hold the House seat upon sentencing for imprisonment, including the suspended jail term.
