Mr. Choung Chou-Ngy, lawyer for opposition leader Sam Rainsy said if the court does not accept his proposal for the formation of a mixed ad hoc border committee to investigate his client's claims of border encroachments by Vietnam, the court should drop all charges against his client, reports Cambodian Express News.
Opposition leader Sam Rainsy was convicted and sentenced in absentia to 2 years jail for uprooting six wooden border stakes in 2009, but faced fresh charges of falsifying border documents and spreading disinformation when he published a series of maps and documents purported to show encroachments by Vietnam.
Investigating Judge Oeung Sieng rejected the two proposals put forward by Sam Rainsy's lawyer, a request for court to provide border coordinates and the setting up of an ad hoc border committee. He said the case against Sam Rainsy is still under investigation.
If convicted of the charges, Mr. Sam Rainsy faces 5-18 years imprisonment on top of the 2 years sentence handed down by the Svay Rieng Court on 27th January 2010 for leading 100 villagers to uproot the border posts on 25th October 2009.
