Regarding the persistent violations of the Indigenous Khmer Krom
Peoples� human rights, fundamental freedoms, freedoms of practice and
worship of Theravada Buddhism, and right to exercise the right to self-determination
in international law by the Socialist Republic of Vietnam

We, the undersigned, Khmer Krom peaceful protesters, Khmer Krom Buddhist
monks, all Khmer people in general around the globe, Supporters and Friends,
Considering the French Republic, by its law no. 49-733 of 4 June 1949, transferred its
colony of Cochin China or Kampuchea Krom, the homeland of Khmer Krom to the
Vietnamese Emperor Bao Dai without the plebiscite of the Indigenous Khmer Krom
Peoples,
Considering President George W. Bush�s endorsement for Hanoi�s admission into the
World Trade Organization at the 2006 Asia Pacific Economic CooperationMeeting
in Hanoi, the removal of Vietnam from a list of a Country of Particular Concern
(CPC), and the granting of Permanent Normal Trade Relations (PNTR) between
Vietnam and the United States which were all based on Vietnam�s superficial
improvement of its human rights record,
Considering the Membership of Vietnam to the United Nations, the U.S.-Vietnam�s
Permanent Normal Trade Relations (PNTR), the World Trade Organization (WTO)
for which Vietnam was not entitled to because of its endless, ongoing, continuous nonstop
human rights violations against the Indigenous Khmer Krom Peoples, the
Montagnards, the Hmongs, other ethnic minorities groups, and other people in Vietnam,
Considering the cancellation of scheduled films to be screened at the 22 May 2007,
Sixth Session of the UNPFII in New York: one film, �Hunted Like Animals� depicting
the story of the Hmong Lao people, hiding and starving in remote mountainous jungles
for over 30 years�forced by military aggression to flee their homeland and become
refugees, and another film, �Eliminated Without Bleeding� depicting the atrocious and
inhumane colonial rules of Vietnam over the Indigenous Khmer Krom Peoples,
Considering the most recent brutal defrocking of Venerable Tim Sakhorn, Abbot of
Watt North Phnom Den, Kirivong district, Takeo province, Cambodia, and hisPage 02
mysterious deportation to be incarcerated in Vietnam in flagrant violation of Buddhist
laws, disciplines and teachings and the supreme law of Cambodia, the state Constitution,
Considering five Khmer Krom Buddhist monks who have been arrested, defrocked and
sentenced to two and four years in prison for staging peaceful demonstration demanding
the Vietnamese local authorities to stop violating Khmer Krom Buddhist monks�
religious rights and freedoms,
Considering sixteen Khmer Krom Buddhist monks who protested against Vietnamese
authorities in Khleang province got arrested and defrocked,
Considering seven Khmer Krom Buddhist monks who have been arrested and then
disappeared since the peaceful demonstration in Khleang province on 22 February 2007,
Considering the impunity culture of Vietnam that is often and/or always overlooked by
the United Nations and the international community, its members and institutions
regarding human rights, especially the persistent human rights violations and the
extrajudicial killings of the Indigenous Khmer Krom Peoples, the Montagnards , the
Hmongs, other ethnic minorities and other people in Vietnam,
Considering the interference of Hanoi�s authorities in our Khmer Krom�s Theravada
Buddhism affairs by forcing Khmer Krom Buddhist monks to be integrated into and be
placed under the control of the Vietnamese United Buddhist Association in order to
eliminate Khmer Krom�s Theravada Buddhism,
Considering the Principles contained in the Charter of the United Nations, especially
Chapter II, Article 6 regarding Membership, Chapter XI (Declaration Regarding Non-
Self-Governing Territories), Chapter XII (International Trusteeship System), and
Chapter XIII (The Trusteeship Council),
Considering the international treaties, conventions and covenants regarding human rights
that Vietnam is one of the signatories,
Considering the United Nations General Assembly resolution 1514(XV) of 14
December 1960 regarding the declaration on the granting of independence to colonial
countries and peoples,
Considering the United Nations General Assembly resolution 1541(XV), which
complemented the Declaration on decolonization, affirmed that there were three ways
in which aNon-Self-Governing Territory could attain a full measure of selfgovernment,
as envisaged in the Charter. These three ways were: a) Free association
with an independent State as a result of a free and voluntary choice by the people of the
Territory expressed through an informed and democratic process; b) Integration with anPage 03
independent State on the basis of complete equality between the peoples of the Non-Self-
Governing and those of the independent State; c) Independence. Whatever option is
chosen by the peoples of a Non-Self-Governing Territory, this choice must be the result
of the freely expressed wishes of these peoples,
Considering the 2001-2010 Second International Decade and its Plan of Action for
the Eradication of Colonialism in the 21st century,
Considering the UNPO�s document that stated, �The international community, its
members and institutions have an obligation to act where international law,
including human rights and especially the right to self-determination, is violated.
The time to act is always now, not when a conflict is �ripe� for resolution, as some
would have it.�,
Considering the two UNPO�s letters dated respectively 02 and 05 September 2003 to
H.E. Phan Van Khai, Prime Minister of the Socialist Republic of Vietnam (SRV)
appealing and requesting him to decolonize Kampuchea Krom and to place it under the
United Nations� control,
Considering the recent proclamation of the United Nations Human Rights Council
regarding the rights of the indigenous peoples,
Considering the Universal Declaration of Human Rights,
Considering the ongoing, continuous non-stop violations of the Indigenous Khmer
Krom Peoples� human rights, fundamental religious freedoms and recognized and
guaranteed right to self-determination and independence by the Socialist Republic of
Vietnam,
Considering the persistent human rights violations of Vietnam against the Indigenous
Khmer Krom Buddhist monks and Khmer Krom Peoples since 22 February 2007 in
Kampuchea Krom and in Cambodia and recently the brutal and illegal defrocking and the
forced deportation and the illegal incarceration of the former Venerable Tim Sakhorn,
Abbot of Watt Phnom Den North of Kirivong district, Takeo province, Cambodia, falsely
accusing him of working for the Khmers Kampuchea Krom Federation (KKF), of
illegally crossing the border to Vietnam and of undermining the good friendship relation
between Cambodia and Vietnam,
Considering the global peaceful demonstrations of Khmer Krom peoples, Khmer
Krom Buddhist monks and their friends and supporters in Australia, USA, France,
Canada and Cambodia urging the release of Venerable Tim Sakhorn from jail in
Vietnam and his return to Cambodia for trial, if any, because of his innocence and of his
Khmer nationality, not Vietnamese�,Page 04
Considering the persistent appeals and requests of the local and international human
rights organizations to find Venerable Tim Sakhorn'�s whereabouts, to release him
unconditionally from jail in Vietnam and to send him back to Cambodia, and also to find
out any Cambodian officials and authorities who were involved in his forced deportation
to Vietnam after defrocking that was in flagrant violation of the Buddhist laws, Buddhist
teachings and the Cambodian Constitution,
Considering the excellent remarks of H.E. Dr. Asha-Rose Migiro, UN Deputy
Secretary-General at the opening of the 2007 session of the Special Committee on
decolonization in New York, 22 February which stated, �The United Nations and the
international community have a responsibility to bring about a speedy, successful
and sustainable solution for the total eradication of colonialism. And, if we are to
close this chapter in human affairs, we need to focus on pragmatic steps.�,
TRONGLY urge the United Nations and the international community to urgently
respond to the following appeals, requests and suggestions as matters of priorities for
the survival and the dignity of the Indigenous Khmer Krom Peoples of the Southern
Vietnamor the former French Cochin China or Kampuchea Kromin Khmer, their
ancestral homeland for thousands of years as evidenced by their Khmer race, heritage,
creed, belief, culture, language, customs, traditions, hundreds of Buddhist temples and
Pali schools, and inscriptions in wood and in stone etc.:
1) Must reinstate the economic embargo on Vietnam for its persistent human
rights violations against the Indigenous Khmer Krom Peoples, the legitimate
and rightful owners of the Territory, the other indigenous minorities, ethnic
minorities groups and other people in Vietnam;
2) Must expel Vietnam from the world body for its persistent violations of the
Principles contained in the UN Charter;
3) Must include Kampuchea Krom or former French Cochin China or Southern
Vietnam or the Mekong Delta region in the list of countries and peoples to
decide for their future;
4) Must open the UN Human Rights Offices in the Mekong Delta region where
the Indigenous Khmer Krom Peoples are living in greater communities;
5) Must have periodic visiting missions of the United Nations Rapporteurs on
the situation of Human Rights, Religious Freedoms, Women Rights and
Children to the Mekong Delta region;
6) Must have at least one or two visiting missions of the UN Deputy
Secretary-General to the Mekong Delta region or other UN officials as the
official Representatives of the UN Secretary-General in formal executionPage 05
and practical application of the UN GA Resolution 2001-2010 Second
International Decade for the Eradication of Colonialism and its Plan of
Action in the 21st century ;
7) Pressure Vietnam to immediately release all Khmer Krom Buddhist monks
from jails and to re-ordain them in accordance with the Buddhist laws,
disciplines and teachings;
8) Pressure Vietnam to comply fully with the UN GA Resolution 2001-2010
Second International Decade and its Plan of Action for the total
eradication of its colonialism over Kampuchea Krom and Khmer Krom
Peoples by cooperating with the UN bodies, the UN system, the international
organizations, and the NGOs to help Khmer Krom Peoples to exercise their
right to self-determination as a matter of priority in accordance with the UN
GA resolutions 1514(XV) of 14 December 1960 and 1541(XV) of 15
December 1960;
9) Punish Vietnam for its persistent and flagrant human rights violations against
the Indigenous Khmer Krom Peoples, the legitimate and rightful owners of the
Territory, the Montagnards, the Hmongs, the other ethnic minorities groups
and other people in Vietnam;
10) Pressure the Cambodian Government to demand Vietnam to immediately
release former Venerable Tim Sakhorn from jail in Vietnam and to send
him back unconditionally and without delay to Cambodia;
11) Pressure the Cambodian government to severely punish those ministerial,
departmental, provincial, and local district, commune and village officials and
authorities that were involved in the illegal defrocking and forced
deportation ofVenerable Tim Sakhorn, Abbot of Watt North Phnom Den
to Vietnam;
12) Pressure the Cambodian government, especially the Ministry of Culture and
Religion to fire the Patriarch Non Nget and the Highest Patriarch Tep
Vong from the monasteries for both supreme chiefs monks are not really
representing nationally Khmer Theravada Buddhism and Khmer
Buddhist monks in general, but theHanoi Communist Central Party�s
monks of 7 January 1979;
13) Faithfully help and assist the Indigenous Khmer Krom Peoples to exercise
their right to self-determination and independence in accordance with the
current international law through the dialogues with Vietnam, the
administering Power in order to prepare for and set up the self-determination
referendums as the UN used to do for the Tokelau people in New Zealand and
for other non-self-governing countries and territories in the past decades;
14) Must avoid the big mistake committed by the UN in the past decades by
granting the international seat and or floor to the Khmer Rouge Pol Pot and
his clique to voice their cheap and dirty lies to the world that Khmer people
under their great and clairvoyant leadership ate three times a day including
dessert. But ironically, Khmer people were starved to death, exposed to
hardship and mass execution without being known to the world and without
checking on their lies by the United Nations until about two million innocent
lives were perished during the Pol Pot time or the Killing Field. Therefore,
the United Nations and the international community must keep their eyes on
the very real, true suffering of the Indigenous Khmer Krom Peoples that have
been oppressed, persecuted, prosecuted, tortured, imprisoned, murdered,
suppressed, eliminated without bleeding, etc. by the atrocious colonial rules of
Vietnam;
15)Decolonize Kampuchea Kromor former French Cochin China or
Southern Vietnam or Mekong Delta region and place it under the United
Nations� control; and
16) Finally, if Vietnam, as a United Nations� Member State or Member Nation,
will not honor the international law, especially the UN Charter, Chapters XI,
XII, XIII, the two UN landmarks resolutions 1514(XV) and 1541(XV) of
respectively 14 and 15 December 1960, and the 2001-2010 Second
International Decade and its Plan of Action for the Eradication of Colonialism
in the 21st century,
Must take Vietnam to the International Court of Justice (ICJ) to be tried
for its endless human rights violations and its hate and racial crimes
against the Indigenous Khmer Krom Peoples, the legitimate and rightful
owners of Kampuchea Krom for centuries.
