Phay Siphan: Taking Preah Vihear issues to ICJ will destroy MOU

Mr. Phay Siphan (pictured), spokesman for the Cambodian Council of Ministers, said Cambodia does not consider Preah Vihear dispute with Thailand as a dispute between a nation and a nation.

He also said that taking the issue to the International Court of Justice (ICJ) will destroy the Memorandum of Understanding signed between the two countries in 2000.

Recently, critics and opposition MPs criticised the government for not taking the matter to the ICJ. In response to the criticsm, Mr. Phay Siphan told the Phnom Penh Post that Cambodia does not consider Preah Vihear issue as a dispute between a nation and a nation.

"This is the freedom of the opposition groups. Up until now, we have never considered the Preah Vihear dispute as a dispute between a nation and a nation. We consider the Preah Vihear dispute as a separate issue because we have now completed drawing up 70% of the map from Anlong Veng to Chaim Yeam Pass", he said.

He added: "So, if we take this dispute to resolve it outside of the agreement, it means that we have destroyed the 2000 MOU."

He said the opposition parties must understand the 2000 MOU. He said the agreement has created co-operations between Cambodia and Thailand to maintain peace in order to resolve what both countries have agreed in 1904 and 1907 which led to the drawing up of the maps in 1908.

He added that if the issue is resolved outside of the 2000 MOU, then both countries have to redraw the 1908 maps. He said that the Preah Vihear issue is a technical issue, not a political issue between the two countries.

Mr. Siphan, I don't understand your rationale here. Thailand has already destroyed the MOU when it sent troops to invade P.Vihear on 15 July 2008.
I also don't understand why Cambodia and Thailand have to draw another map. Both countries have the 1908 maps which the international court used to judge the P.Vihear case in 1962. If we draw another map it means the 1908 map is invalid.
