The court delays Heng Pov hearing

The Appeal Court has on Tuesday decided to delay Mr. Heng Pov's court hearing because Mr. Heng Pov did not have the money to pay his lawyers' services which has amounted to $10,000.

The trial date has not been re-scheduled.

Mr. Kao Sopha, Heng Pov's lawyers, told reporters outside the court that it is a good thing that the court decided to delay the trial of his client.

Mr. Sopha said: "The delay was because Mr. Heng Pov did not have the money to pay for my services. We have lodged a request with the Phnom Penh court (to allow Mr. heng Pov to withdraw his frozen assets from the bank) on 4th February. We also wrote to Prime Minister Hun Sen to intervene in allowing Heng Pov to withdraw some of his frozen money to spend on three things: First, for his health treatments. Second, for his children's education and third, to pay for his defence lawyers."

Mr. Heng Pov said through his lawyers that his original court hearing was on charges of illegal possessions which the Phnom Penh Court sentenced him to 18 months and fined him Riel 2 million ($500).

Mr. Heng Pov, ex-Deputy Police commissioner, has complained that all his children have dropped out of studies because they don't have the money to pay for the tuition. He also complained that he has no money to pay for his health treatments as well as paying his lawyers.

Mr. Heng Pov said that he doesn't want to comment about charges of illegal arms possessions because he wants to leave the court to make its own decisions. He said: "I wish to demand the court to decide based on the laws. Even if the court does not decide based on the laws, it is up to the court's decision. I do not need to face the court any further."
According to his lawyer, Mr. Heng Pov wrote to Prime Minister Hun Sen requesting to withdraw $93,000 from his frozen bank account.

Mr. Heng Pov is yet to receive a reply from the prime minier.

Mr. Heng Pov, ex-Police Commissioner of Phnom Penh Police, was sentenced to 58 years imprisonment on 6 charges of murders, kidnappings, illegal arms possessions and other charges.
