Koh Kong Provincial Court planned to summon two journalists working for The Cambodia Daily to appear before the court to answer in relations to the murder of environmentalist Chut Wutty and military policeman In Ratana.
Neang Boratino, coordinator for human rights group Adhoc, said that Srey Makny, deputy prosecutor of Koh Kong Provincial Court, planned to summon the two Cambodia Daily journalists, Miss Phorn Bopha and Miss Olesia Plokhii, who were with Chut Wutty when he was shot dead on 26th April, to appear before the court on 17th May. "Yes, it's true that they will be summoned on 17th May. It is the prosecutor who summoned them. So, I think it is related to the murder of Chut Wutty", he said.
RFA could not reach Srey Makny for comment in relation to the summons as a call to his phone went unanswered.
Mr. Mony Makara, investigating judge, has refused to comment, saying it is a court's secret. "Sorry, this is a secret, I cannot provide any answers. Sorry, this is forbidden by laws", he said.
RFA is unable to reach Miss Phorn Bopha and Miss Plokhii for comment.
However, Chheuy Udom Reaksmey, the eldest son of Chut Wutty, appealed to the authority to find the real killers. "I want the court to allow the two journalists, who saw the killing of my father, to speak the truth, please try to speak the truth. This is what I wanted. I want to see transparency, no bias and untruth", he said.
Chut Wutty was shot dead on 26th April while investigating illegal logging in Mondul Seima district in Koh Kong province. Initial police report said Chut Wutty and In Ratana shot each other to death in an argument. Later, the police said In Ratana shot dead Chut Wutty, but one of his bullets ricocheted to kill him when it hit Wutty's car. Later, the police report was changed again, this time saying that In Ratana shot dead Chut Wutty and committed suicide by shooting himself twice with an AK-47 riffle, one in the stomach and the other in the chest, because he fears that he will be prosecuted for the murder of Chut Wutty. The first investigation into the murders of the two was closed less than one day after the killings took place.
However, after national and international outcry, Prime Minister Hun Sen ordered another investigation. The investigation committee was formed in a hurry and the investigation was completed in two days, with some critics saying that the investigation was completed even before it has begun. The investigation committee concluded that military policeman In Ratana killed Chut Wutty in a rage and another policeman, Ran Boroth, who is his friend, tried to grab the AK-47 from him, causing it to discharge twice, killing In Ratana instantly. Rann Boroth is now charged with manslaughter and may face up to 3 years jail if convicted.
Families of both victims, human rights groups and political observers did not belief the report of the investigation committee, saying that it is an official cover up.
