The Cambodian Appeal Court will hear Mr. Sam Rainsy's appeal against his 10 years sentence for document forgery and spreading disinformation after he had published a series of documents and maps purporting to show Vietnam's encroachments of Cambodia's borders.
Mr. Ngeth Sarath, prosecutor of the Appeal Court, had summoned Mr. Sam Rainsy (pictured), who is in self-exiled in Paris, to appear before the court at 8 a.m on 20th September.
Mr. Yim Sovan, spokesman for the Sam Rainsy Party (SRP), said he is not interested in the court's proceeding because he considers the court to be subservient to the the ruling Cambodian People's Party (CPP) and, therefore, has been used as a political tool to persecute oppositions and government critics. "It is a CPP's court which has been used as a tool to harass the SRP. No country in the world had sentenced a patriot, only Cambodia. The patriots, the nation's defenders and the people's defenders were prosecuted. This is disappointing and is a bad example for encouraging other Cambodian patriots (to stand up for the country)", he said.
Mr. Ou Virak, director of Cambodian Centre for Human Rights, said Mr. Sam Rainsy's case is a political case because what he did was to defend his nation and his people against foreign encroachments. "This case is completely is a political case. I think that the use of a court in a political case is a suppression of political rights. This sort of suppression will further weaken the oppositions and will discourage the younger generations from entering politics. This sort of action will make it appears that the political arena is only a place for gangsters. So there is a limit for the intellectuals, the political aspirants and political participants (to enter politics). I see that it is a dangerous thing for the development of Cambodia", he said.
Despite all the legal hurdles Mr. Sam Rainsy is facing, Mr. Yim Sovan is hopeful that Mr. Sam Rainsy will be able to return to Cambodia before the 2012 commune election and the 2013 parliamentary election after the intervention of the international community. He, however, said that it is strange that the government is suing all patriots who dare to come out and defend Cambodian borders against foreign encroachments. He said, this cause of action will discourage younger generations from entering politics. "To encourage the younger generation, this generation of leaders must be mindful of their mistakes that will be recorded in the history. If they continue to threaten and intimidate the patriots and those who dare to stand up against foreign encroachments, especially our eastern borders, when Vietnam planted the border posts inside Cambodian territory, our president (Sam Rainsy) will become a national hero. But, the present court has been used as a political tool to protect the political interests of the ruling elites and to protect the interests of foreign countries, that is an action that should be avoided", he said.
A senior MP from the ruling CPP, Mr. Cheam Yeap, said there will be no political compromise to allow Mr. Sam Rainsy to return to Cambodia and he will lose all his rights to contest in any elections, until he had served two-thirds of his total 14 years sentences.
Some people had likened Mr. Sam Rainsy's case to that of his father's, Sam Sary, who was seen by his supporters as being constantly persecuted by the ruling Sangkum Reastr Niyum Party after he had a fall-out with Sihanouk and had eventually disappeared without a trace in 1962.

It looks like the history repeat itself. Soon Sam Rainsy will loose all of his support and forgotten. He is already out of touch on some of his ideology already. He should let his party to change name and pick new leadership. It is not too late for him to do damage control. SRP will not be the same. Sam Rainsy day is over. If he doesn't bring new ideas, fresh leadership and allow opportunity for others; SRP is destroying itself.

To comment above, it should stated "SRP supporters should be ashame of themselves for allowing the party to be destroy under Sam Rainsy self serving philosophy". Many Cambodian support CPP, why they should feel ashame? Their party still standing. They are happy to see Sam Rainsy destroy. SRP supporters should be thinking of ways to remain in the competition in 2013 with Sam Rainsy. Sam Rainsy is good guy but he cannot do anything if he remains outside. Who should represent the party in the next election? The poem writer? You don't have that many choice isn't it?
Yes, I agree, no country in the world persecute and prosecute a patriot like Sam Rainsy whose only crime is to try to defend Khmer territory. If Cambodia has more people like Sam Rainsy, Cambodia's territory will be protected, but if Cambodia has more of people like Hun Sen, Cambodia will be no more in 50 to 100 years.

Even an individual opinion needs to be respected. Good doctor always wants to save patient life regardless of the cost. No dispute about Sam Ransey wants to protect Khmer lands but at what cost and outcomes?
Not all patient are willing to spend all fortune and leave the family behind in destitute just to try if he/she could get the once healthy state back even without guaranty. He/she wants all tubes pull out and the doctor has to respect that wish. Let me say this, I would bring comets or asteroids to destroy our enemy who stole and attempt to steal our land if I could but I don't want war now that will destroy Khmer land. We need to develop our country and get strong first and automatically no enemy will want to bully or steal anything from us. Sam Rainsy should accept Dep.PM post when Hun Sen offered him if that was true.Be straight about this,I'm not a CPP. I live in the US,and the corrupted CPP members need to clean up asap for the nation and their own sake.I also want to salute all Khmer Soldiers who protect our country.
