The Constitution Court on Tuesday ruled that a Joint Communique Thai Foreign Minister Noppadon Pattama signed with Cambodia over Preah Vihear Temple in June is unconstitutional.
The Court's Secretary General Paiboon Warahapaiboon said signing of such agreement with Cambodia needed an approval from the Parliament first.
"The Joint communique with Cambodia is considered a treaty in accordance with the Vienna Convention 1969 and the Thai Constitution's Article 190 which needs an approval from the Parliament first," he said.
The Constitution Court judges voted 8 to 1 that the agreement needed the green light from the Parliament first.
Noppadon signed the agreement with Cambodia's Deputy Prime Sok An on June 18, 2008.
