អគ្គនាយក​ក្រុមហ៊ុន ម៉ុង ឬទ្ធី គ្រុប និង​ជា​ប្រធាន​ក្រុម​ការងារ​ផ្នែក​កសិកម្ម និង​កសិឧស្សាហកម្ម​ផ្នែក​ឯកជន លោក ម៉ុង ឬទ្ធី បាន​ប្រាប់​វិទ្យុ​អាស៊ីសេរី នៅ​ថ្ងៃ​ទី​៣០ ខែ​មីនា ថា កន្លង​មក ក្រុមហ៊ុន​លោក​នាំ​ចេញ​ផ្លែ​ស្វាយ​ទៅ​ទីផ្សារ​ប្រទេស​ចិន ច្រើន​ជាង​គេ។ លោក​អះអាង​ថា បរិមាណ​ស្វាយ​ជាង ២០០​តោន​នេះ ក្រុមហ៊ុន​បាន​ប្រមូល​ទិញ​ពី​ប្រជា​កសិករ​នៅ​ក្នុង​ខេត្ត​មួយ​ចំនួន ដូចជា ខេត្ត​កំពង់ស្ពឺ កំពត និង​កណ្ដាល ដែល​កំពុង​ប្រឈម​បញ្ហា​ខ្វះ​ទីផ្សារ៖ «តាម​យន្តហោះ​ចឹង​យើង​នាំ​ចេញ​មិន​ទាន់​បាន​ច្រើន​នៅ​ឡើយ​ទេ ប្រហែល​ជាង ២០០​តោន​ប៉ុណ្ណោះ​ក្នុង​ឆ្នាំ​២០១៦ ដែល​ជំហាន​ដំបូង ខ្ញុំ​នាំ​ចេញ​តែ​ស្វាយ​កែវ​រមៀត នៅ​ឡើយ ហើយ​ជំហាន​ក្រោយ យើង​នាំ​ចេញ​ស្វាយ​ពីរ​ប្រភេទ គឺ​ស្វាយ​អាយវ៉ែន និង​ស្វាយ​ប៉ោម អូស្ត្រាលី ទៅ ហើយ​បើ​ប្រភព​ស្វាយ​យើង​ប្រមូល​តិច​ពី​ស្រុក​ភ្នំស្រួច ក្នុង​ខេត្ត​កំពង់ស្ពឺ កំពត អ្នក​ដាំ​តាម​ទន្លេ​បាសាក់ និង​ទន្លេ​មេគង្គ​ជាដើម យក​ពី​ប្រភព​ដែល​ខ្វះ​ទីផ្សារ»។

របាយការណ៍​របស់​ក្រសួង​កសិកម្ម រុក្ខាប្រមាញ់ និង​នេសាទ បង្ហាញ​ថា កាល​ពី​ឆ្នាំ​២០១៤ កម្ពុជា មាន​ផ្ទៃដី​ផលិត​ស្វាយ​ប្រមាណ​ជាង ៦​ម៉ឺន ៥​ពាន់​ហិកតារ (៦៥.២៥១​ហិកតារ) នៅ​ទូទាំង​ប្រទេស។ ជាង​នេះ​ទៀត កាល​ពី​ចុង​ឆ្នាំ​២០១៥ កន្លង​ទៅ ក្រសួង​កសិកម្ម បាន​ចុះ​អនុស្សរណៈ​យោគយល់​គ្នា (MOU) ជាមួយ​រដ្ឋាភិបាល​កូរ៉េ លើ​ការ​នាំ​ចេញ​ផ្លែ​ស្វាយ​ស្រស់​របស់​កម្ពុជា ទៅ​កាន់​ទីផ្សារ​ប្រទេស​កូរ៉េ ដើម្បី​ពង្រីក​ទីផ្សារ​អន្តរជាតិ​ឲ្យ​បាន​កាន់​តែ​ទូលាយ។

Justice Still Elusive in Cambodian Grenade Attack

Nearly two decades after a deadly grenade attack killed at least 16 and wounded more than 150 people during a pro-democracy rally at Phnom Penh’s Wat Botum Park, victims of the attack and their families are still waiting for justice.

The notorious March 30, 1997 attack came after opposition leader Sam Rainsy and his supporters gathered in a park across from the National Assembly in Phnom Penh to denounce the judiciary’s lack of independence and judicial corruption.

While Sam Rainsy is thought to have been the target of the attack, the assailants missed him, killing his bodyguard, as well as some protesters and bystanders. The blasts blew the limbs off nearby street vendors.

According to eye-witness accounts, the people who threw the grenades ran toward Prime Minister Hun Sen’s riot-gear clad bodyguards, who allowed them to escape.

An FBI report declassified in 2009 indicated that Cambodian police possessed prior knowledge of the attack and that there was the possibility that the attackers colluded with Hun Sen’s bodyguard unit.

Despite the toll of death and dismemberment, no one has been arrested for the attack, leaving victims and family members still searching for justice.

One man is missing and presumed dead, and there are concerns about an oil slick of unknown size after a Kampuchea Tela oil tanker crashed into a jetty belonging to the company at Sihanoukville.

The 100-metre-wide docking platform and about 80 metres of jetty at the end of the 1,200-metre-long structure were destroyed after being struck by the Vietnamese tanker at about 4pm on Tuesday.

Preah Sihanouk provincial police deputy chief Kol Phaly said “many” port workers were rescued from the water by the crew of the tanker.

However, one security guard, Sem Vannak, 18, who lived in a post on the platform, disappeared when it and other structures fell into the sea.

“As of 3pm on Wednesday, the victim has not been found yet,” said Phaly. “In the meantime, our authorities are interrogating the crews and workers about the incident.

“It is the first time that such an incident has happened in Cambodia,” he added.

Workers interviewed by the police said the oil tanker had been attempting to unload oil at the facility, located about 10km north of the Sihanoukville Autonomous Port, when the ship ran into the platform without slowing down, said Stung Hav district police chief Ros Key.

They said they had not yet determined what caused the accident.

Gov’t vows to monitor borders to stop illegal rice

The government has decided to strengthen entry points along Cambodia’s borders to block illegal rice imports, while promising to dissolve any company’s certificate of origin that is caught mixing contraband rice for export, Cambodian Rice Federation (CRF) president Sok Puthyvuth announced following a meeting yesterday with Deputy Prime Minister Kheat Chhon.

Additionally, the government will scrap the value added tax (VAT) on imports of rice milling machinery – a move aimed at reducing millers’ high capital costs.

“As result of the meeting, the government has decided to drop the VAT on milling machines for the rice industry,” Puthyvuth said.

Members of a government task force attending the closed-door meeting also considered a request by the CRISIS (Cambodian Rice Industry Survival Implementation Strategy) initiative for the government to facilitate $250 million in soft loans to rice millers.

The funding package aims at reducing the financial burden on millers, who typically have to take loans out at 8 to 10 per cent interest from commercial banks or 20 to 30 per cent interest from microfinance lenders.

Capital’s drug arrests double

Drug seizures and arrests in the capital more than doubled last year, according to the Phnom Penh Municipal Police’s 2015 annual report released yesterday.

According to the report, the police made 465 drug busts last year, an increase of 255 over 2014. Police also made 1,260 individual drug-related arrests, an increase of 701.

“In 2015, the drug issues in Phnom Penh city are still a challenge and complicated, because the criminals attempted to use the city as a target for circulation [of narcotics] to other countries for regional and domestic distribution,” the document says, echoing findings made by the United Nations Office on Drugs and Crime (UNODC) in February that the Kingdom is a transit hub in the international drug trade.

The report links the prevalence of drug use in communities to higher crime rates, citing the homeless and youth as the main drug-using population.

“The drug users have caused crimes including robbing, stealing, murdering, and raping women and children,” it says.

Takhmao police chief sentenced on drug charges

A retired police chief in Kandal’s Takhmao district charged with possession and intent to distribute 13 1-gram bags of crystal meth was found guilty and sentenced in Kandal provincial court to two years prison on Monday, after a judge rejected a defence that the drug was medicinal.

In court, Mom Vath, 64, admitted to buying the drug but claimed he was only using it to treat his gastritis – a painful inflammation of the stomach.

However, presiding judge Phong Van yesterday told the Post he did not believe this explanation, especially given that the suspect could not produce a prescription.

“He would only not be guilty if he had a prescription from a licensed doctor,” said the judge. “We can’t believe his words. We believe he bought them for selling.”

Amphetamines are not typically prescribed for stomach ailments, according to the US National Institute on Drug Abuse.

On the contrary, using meth may create gastric problems like cramps and obstruction.

Court officials and police declined to explain how Vath was discovered to be in possession of the drugs.

The Cambodia National Rescue Party held a ceremony yesterday to mark the anniversary of the deadly grenade attack that killed 16 people and injured hundreds more at an opposition rally in 1997.

Speaking to supporters via video link from France, opposition leader Sam Rainsy claimed that French courts had reopened an investigation into the case as more information had recently come to light.

"We will start to see the light of justice," he said.

Although the Cambodian courts are still technically investigating the case, no arrests have ever been made in connection to the attack, which was widely believed to have been carried out by supporters of then Co-Prime Minister Hun Sen.

Council of Ministers spokesman Phay Siphan yesterday played down Rainsy’s claims of a French investigation, saying it was in the jurisdiction of Cambodian courts.

My dear friend Scott Leiper passed away on March 28 after a nine-month struggle with pancreatic cancer. He was 61.

For his family and his countless friends in Cambodia and around the world, he left us too soon, and we are all now forced to wrestle with the pain of what Scott himself wrote to me in one of his last emails from the States: “life is not fair”.

Scott spent the past 34 years working to improve the welfare of the Cambodian people. Initially, on the Thai border starting in 1982 when he ended up there as a near-penniless backpacker looking for a mission, he worked with Cambodian refugees in the camps. Later, in 1989 with the World Food Programme, he moved to Phnom Penh to set up WFP’s operations here.

After UNTAC he helped establish Carere, which over time morphed into SEILA, and then eventually became the National Committee for Sub-National Democratic Development (NCDD), a Cambodian government initiative that has sought to strengthen the role and capabilities of the Kingdom’s Commune Councils.

In everything Scott did he was decent, caring, thoughtful, determined, pragmatic, patient and prescient. He knew there were no quick-fix miracles in the development world.

He knew that the process of Cambodia’s recovery from decades of conflict and mass murder was an arduous process where every small step forward was an equally small victory.

Turtles, pythons saved en route to Vietnam

One of the effects of the existence of the 'good' relations between Cambodia and Vietnam following the installing in power of the current CPP regime in 1979 by Hanoi has been the unprecedented rape and over-exploitation of the country's wildlife, fishery and some rare animal species as well as domestic animals [such as dogs kidnapped, traded to feed dog meat market in Vietnam and in selective eateries in Cambodia] king cobras and various venomous and non-venous snakes that feed on rats thus helping farmers to keep rat population to a minimum and off their rice fields. 

Vietnam and Cambodia may be next door neighbours and have been so for centuries, yet the differences in cultural attitude, morality, demographic density, share and use of natural riches couldn't be more pronounced. Within the same period [a blink of an eye in this country's thousand long history] and for the first time, these ecological balance and natural food source have been scaled down to the point of irreversible extinction and crisis, and unlike the "social engineering" and ideological blunders of the Pol Pot regime, the catastrophe has been man-made of a somewhat different nature: greed sponsored by official corruption. In most rivers and lakes here, even juvenile fish species are not spared. Yet, the most reprehensible agency of this crisis is not even the mass influx of Vietnamese settlers into the country, which most Cambodians feel need to be curbed or even reversed, but rather, the dysfunctional capacity of the authorities and or their unwillingness to get to the core of the crisis and taking it head on. The mass floating Vietnamese settlement/shanty town situated in the province of Kg Chhnang, among other such residential anarchies in the country are living testimonies to this administrative malfunction. 

When a once naturally rich, abundant and plentiful land dies, sooner or later, its loss will be felt by all, whatever their 'race' or ethnicity.

Turtles, pythons saved en route to Vietnam

A truck carrying 103 endangered yellow-headed temple turtles, six Burmese pythons and 11 reticulated pythons intended for sale in Vietnam was intercepted in Kandal’s Kien Svay district on Monday by Forestry Administration (FA) officials.

According to E Sophy, chief of the Kien Svay district FA, the 18-wheeler was loaded with 443 kilograms of turtles and 127 kilograms of pythons packed in bags.

“We got a tip that the truck was setting off from Battambang province,” Sophy said, adding that “it is the hugest ever crackdown” under his watch.

However, the driver of the truck managed to escape during the inspection because “we did not have many officers”, Sophy said.

Sophy said the individual responsible has one month to pay a fine before the case is handed to a court.

Hun Manet’s tour of the United States has hit another snag.

Days after bowing out of a planned Khmer New Year parade in Long Beach, California, in response to a local backlash, the prime minister’s eldest son has seen Phnom Penh sister city Lowell, Massachusetts, home to the US’s second-largest Cambodian community, roll up the red carpet.

On Tuesday, the Lowell city council voted to “denounce” the impending visit. However, the council had yet to decide whether to accept the RCAF lieutenant general’s intended gift, a replica of a statue of Jayavarman VII.

Lowell Mayor Edward J Kennedy – who abstained from the otherwise unanimous 8-0 vote – will also decline to meet with Manet, an aide told the Post.

Images and video posted by the paper online show hundreds of protesters gathered inside the city hall with signs bearing slogans such as “Dictatorship is not welcome in Lowell” and “Stop unlawful evictions”. While dozens of residents spoke against welcoming Manet, several dissenting voices spoke on his behalf, though they were met with boos.

“I fully support the sister city relationship between Phnom Penh and the City of Lowell,” said resident Chea Sarun in a video in which he addresses the city hall in Khmer with an interpreter.

A Phnom Penh Municipal Court prosecutor has formally charged opposition leader Sam Rainsy over a defamation suit brought by National Assembly president Heng Samrin, according to the plaintiff’s lawyer.

Adding more weight to the slew of legal cases hanging over the CNRP president’s head, prosecutor Vong Bun Visoth forwarded the case to city court judge Ros Piseth “a few days ago” after Rainsy, living in self-imposed exile in France, failed to answer two summonses to contest the allegations, said Ky Tech, lawyer for Samrin.

“The trial may start in three months, probably in June,” Tech said.

Samrin’s complaint relates to a Facebook post by Rainsy in December, which suggested the 1980s regime led initially by Samrin – a forerunner to the Cambodian People’s Party – had indicted late King Norodom Sihanouk of being a traitor and sentenced him, in absentia, to death in a show trial.

In an annual report released yesterday, Phnom Penh’s municipal police once again touted their success in preventing demonstrations and strikes by political parties, civil society groups, and unions, whom they referred to as agitators working to topple the government.

Released at a meeting yesterday, the document, which also covered an array of crime statistics, stated that municipal police had upheld their duties to protect residents from terrorists and “enemies planning to topple the government”.

Officers had “prevented political instability, the break-up of the internal unity, reduced violence, prevented mass social disasters and maintained safety,” the report stated before describing the main agitators’ origins.

“The majority of [demonstrations and strikes] have been perpetuated by some politicians, civil society groups, federations and unions that oppose the government.

[They] stoke incitement and attract activists and protesters to call on the government, ministries, institutions, and relevant local authority to solve their demands.

We have paid attention to these strikes and demonstrations and resolved them through cooperation to protect security and safety and keep order.”

The participation of Cambodian Prime Minister Hun Sen’s son in next month's Cambodian New Year’s Parade that touched off a raucous protest outside last Tuesday’s city council meeting was officially called off Sunday morning, as Hun Manet posted his intentions to pull out of his commitment to the parade after hearing news of the demonstration.

In his post, Manet said he was canceling his plans to be part of the parade because he didn’t want to see a “conflict break out between Khmer and Khmer” that could potentially lead to violence between those who supported his visit and those who did not.

“Khmer New Year is a special occasion for our Khmer people and should unite us in a desire to support our race by working together to show the Khmer culture and civilization to the American people and other citizens,” Manet said. “It is not the time for supporters and non-supporters to show off their muscles, because it shows a break between Khmer and Khmer and gives our race a bad reputation.”

Manet had been invited to be part of the April 10 parade by the Cambodian Coordinating Council (Cam CC) which is charged with the organization of the parade and other events in the Cambodian community.

Anti-Corruption Unit chief Om Yentieng yesterday claimed to have evidence of corruption committed by opposition leader Sam Rainsy, and threatened to investigate the CNRP president if he continues to speak out against the graft case currently levelled at his deputy, Kem Sokha.

In response to comments made by Rainsy on his Facebook page late on Monday, in which he questioned the role of the ACU, Yentieng told Radio France International yesterday that his organisation was sitting on information pertaining to the opposition leader.

“I have information about [Rainsy engaging in corrupt activities], and if he continues to violate the law, we will uncover it,” he said.

In comments posted to his Facebook page late on Monday, Rainsy said the ACU had a responsibility to investigate government corruption, which he described as the misuse of state funds and exploitation of national resources.

The opposition, he said, were not part of the government and “cannot be involved in government corruption”. In an apparent reference to the case of Sokha, who is being investigated by the ACU for purportedly promising cash and property to a alleged mistress, the opposition leader said those not part of the government should not be subject to an ACU investigation as it was a private matter.

As Cambodia moves towards opening its first privately run prison, international experts have warned the government may have misunderstood the concept and cautioned that privatisation likely isn’t the best way to tackle chronic overcrowding in prisons.

At a speech last week, Interior Minister Sar Kheng revealed plans for the first privately built and run prison in the Kingdom, which has more than 17,500 inmates in a penal system with the capacity for 8,500.

Kheng, who cited the use of such facilities in Australia, said upscale lodging at the complex could be rented out to wealthy inmates to generate state income.

However, University of Canberra School of Law and Justice associate professor Lorana Bartels yesterday noted a user-pays system was not how private prisons in Australia and other countries worked.

Private prisons in theory are supposed to save taxpayers’ money, as for-profit owners have an incentive to seek efficiencies.

But in Australia, Bartels said opaque contracts between service providers and the government made it difficult to assess whether private prisons were in fact more efficient than their public counterparts.

“We know that money is changing hands, but we don’t know how much… there’s no way of really saying whether they are achieving this goal,” Bartels said.

The Prey Lang Community Network (PLCN) believe they know who is responsible for a suspected axe attack on a member and have called on the government to take action.

PLCN activist Phon Sopheak suffered leg wounds during the attack in the early hours of Sunday morning as the activists were wrapping up a five-day patrol combating illegal logging in Kratie province.

Several groups of illegal loggers had been caught during the patrol and forced to sign contracts promising not to repeat the offence.

Activist Phay Bunleang said the PLCN believed the final group of loggers caught on Saturday were behind the attack and had passed photos taken during the contract signing to the authorities.

“We are preparing lawsuits as well as passing the photos to the district authorities to look for the suspects,” Bunleang said. “We are also calling for the government to take more action to combat illegal logging in Prey Lang.”

According to a statement issued yesterday, the PLCN has confiscated a total of 85 chainsaws recently across Kampong Thom, Preah Vihear, Stung Treng and Kratie provinces.

“Over the past two months, forestry crimes have reached serious levels. We, the PLCN, are deeply concerned about this situation and death threats issued by illegal loggers,” the statement reads.

Automobile dealers who expected a surge in sales ahead of a scheduled April 1 tax hike on new and used car imports have said that vehicle sales have been surprisingly flat this month.

Pily Wong, CEO of Hung Hiep, the authorised distributor of Volkswagen in Cambodia, said yesterday there had been no noticeable increase in car sales at his showroom despite the impending tax, which will tack an additional 13 per cent onto the total tax bill of new vehicles.

“It’s curious that sales haven’t gone up,” he said. “Even I asked some colleagues in the industry and they also don’t see a surge in people coming to buy cars because of the [imminent] tax increase.”

Wong surmised that the general public was largely unaware of the government’s plan to increase the “specific tax”, a form of excise tax.

According to a sub-decree issued by the Customs and Excise Department in January, the specific tax on imported new and used cars is set to rise on Friday.

Authorised dealers fear the tax hike, which stacks on top existing taxes on imported new vehicles – currently up to 123 per cent – will drive more people to purchase cheaper cars on the grey market.

“I actually don’t know why the government has taken this measure to make the tax even more favourable to used cars, as if we don’t have enough used cars in the market,” said Wong, adding that taxes are highest on newer vehicles with higher engine capacities.

Wanted Russian arrested in Sihanoukville

Sihanoukville police on Monday arrested a Russian national who is wanted back home for allegedly stealing 60 million rubles (about $873,000) from a municipal fund in 2008, following a request by the Russian government.

The Cambodian arrest warrant for Vladimir Vitalievich Batalin, 38, was issued by the Appeal Court in July 2014, according to the court’s head prosecutor, Ouk Savuth.

Cambodian officials were unable to say yesterday when Batalin entered the Kingdom, but they believe he arrived in Sihanoukville on March 25.

According to a 2008 statement by the Interior Department of Russia’s Amur oblast (Amur district), Batalin had a leadership role in a body that funded municipal education and is accused of embezzlement.

Police arrested Batalin on Monday while he was driving in Sihanoukville, said provincial deputy police chief Im Voleak. The arrest was ordered by the Department of Antiterrorism and Border Crime.

According to a letter from the Russian Embassy to the Ministry of Foreign Affairs, the two governments had been in contact about Batalin since 2011. Embassy officials were unavailable yesterday.

Telecommunications company ZTE (Cambodia) may just be one of the biggest companies you’ve never heard of.

It is part of China’s ZTE, a Hong Kong-listed firm which made more than $15 billion in revenues last year and employs some 70,000 people worldwide.

Operating in Cambodia since 2007, Louis Xiang, CEO of ZTE (Cambodia says the company provides “total telecoms solutions”, and is particularly strong in emerging business sectors such as ICT, enterprise and government networks, cloud computing, and the curation, storage and visualisation of ‘big data’.

The Forestry Administration (FA) will leave it up to the military to punish 10 soldiers who, wielding firearms, laid siege to an FA compound in an attempt to re-take a truck that had been seized hauling illegal timber, according to a forestry official.

The group from Unit 243, part of Division 2’s 4th brigade, stormed the FA’s Anlong Veng district headquarters in Oddar Meanchey province on Monday, after FA officers impounded their truck, which had “frequently” been used to transport illegally felled wood timber through the area. The FA officers were forced to barricade the truck inside and call for help.

FA officials yesterday said the body would still file a case against the unit for transporting illegal wood but would rely on the soldiers’ commanders to reprimand them for their antics on Monday.

“Our relevant authorities could arrest them if they opened fire, but they did not fire and none of our officials were injured, so nothing is lost,” said Tieng David, head of the Oddar Meanchey provincial FA.

“However, for the case of their illegal transportation of about six cubic metres of timber, we are processing a complaint. It means they must pay a fine.”

Man Voutthy, deputy chief of Anlong Veng district FA, said he had filed a report to the soldiers’ brigade and division superiors about the incident and that their repeat offences warranted punishment.

Military police spokesman Eng Hy said the body would investigate if asked. However, as the men were caught “red-handed”, judicial authorities could have made the arrests themselves, he said.

Interior Ministry immigration chief Sok Phal yesterday claimed that the five refugees transferred to Cambodia from Australia’s detention centre on Nauru island had no disappointments in their time here, despite three leaving the Kingdom for the countries they fled.

“I think we have given them their rights and freedoms. There are no points the refugees are disappointed with,” Phal said when questioned by a reporter during a press conference on illegal immigration.

Mohammed Rashid, one of the two remaining refugees settled under the $A55 million deal with the Australian government, this month said he regretted coming to Cambodia.

“It was a big mistake for me to come here,” Rashid said.

Phal stressed that the five refugees came of their own free will and refused to be drawn into evaluating the deal’s outcomes.

“Therefore, we cannot say it was unsuccessful or successful; we respected their right [to leave] voluntarily,” said Phal.

A key section of the secret Trans-Pacific Partnership (TPP) trade agreement has been leaked to the public. The New York Times has a major story on the contents of the leaked chapter, and it’s as bad as many of us feared.

Now we know why the corporations and the Obama administration want the TPP, a huge “trade” agreement being negotiated between the United States and 11 other countries, kept secret from the public until it’s too late to stop it.

The section of the TPP that has leaked is the “Investment” chapter that includes investor-state dispute settlement (ISDS) clauses. WikiLeaks has the text and analysis, and the Times has the story, in “Trans-Pacific Partnership Seen as Door for Foreign Suits Against U.S.“:

An ambitious 12-nation trade accord pushed by President Obama would allow foreign corporations to sue the United States government for actions that undermine their investment “expectations” and hurt their business, according to a classified document.

The Trans-Pacific Partnership — a cornerstone of Mr. Obama’s remaining economic agenda — would grant broad powers to multinational companies operating in North America, South America and Asia. Under the accord, still under negotiation but nearing completion, companies and investors would be empowered to challenge regulations, rules, government actions and court rulings — federal, state or local — before tribunals organized under the World Bank or the United Nations.

“The TPP has developed in secret an unaccountable supranational court for multinationals to sue states. This system is a challenge to parliamentary and judicial sovereignty. Similar tribunals have already been shown to chill the adoption of sane environmental protection, public health and public transport policies.”

TPP forecast to give Vietnam a boost over Cambodia

The anticipated ratification of the Trans-Pacific Partnership (TPP) agreement is expected to have a negative impact on Cambodia’s economic growth as Vietnam takes priority as a top trading partner within the 12-member bloc that accounts for 40 per cent of the world’s economy, an academic said yesterday during a lecture organised by the Canadian Chamber of Commerce in Cambodia.

Citing World Bank statistics, Susan Green, a professor of law at the Royal University of Law and Economics, said preferential tariff reductions or eliminations to the US market under the TPP could boost Vietnam’s GDP by 10 per cent by 2030. She said manufacturers were already looking to leverage the trade framework, sinking investment into Vietnam, a member of the TPP, that might otherwise have gone to non-member Cambodia.

“Fabric manufactures in China are reported to be moving to Vietnam now and building major manufacturing facilities so that components can be provided to Vietnam companies,” she said. “This is very significant and it is predicted to bring a lot of job growth.”

“If Cambodia enters the TPP it would either have to produce its own fabric to comply with the rules of origin clause, or import from other TPP countries,” she said, citing the yarn-forward clause that requires raw material to originate within the trading bloc.

A research catalogue of ancient sites and artefacts found in Preah Jayavarman-Norodom National Park, more commonly known as Phnom Kulen, was launched yesterday at the Ministry of Environment.

Published in Khmer by the Ministry’s Department of Nature Conservation and Protection, List of Historical Places at Preah Jayavarman-Norodom National Park (Phnom Kulen) features nearly 200 pages of photographs accompanied by descriptions of style, eras and temple locations.

“Phnom Kulen was the city of Jayavarman II in the ninth century,” Royal University of Phnom Penh history professor Sambo Manara said. “This place is very important for our people, who dedicated their life to the god king.”

Atop Phnom Kulen, he continued, Jayavarman II established his divine rule by devaraja, associating his power with the Hindu god Shiva.

Hundreds of hopeful prospectors chasing rumours of a gold rush in Preah Vihear province’s Rovieng district have ended up empty-handed.

According to Rom Tom’s commune chief, Prak Than, the gold hunters from nearby villages began descending on Rom Deng village on March 24, digging into the side of the mountain and taking the soil home to check for the precious metal.

“But I never saw anyone find anything. I just saw that they spent petrol, food and time,” he said yesterday. “Now, most of them have stopped and they feel disappointed.”

He said local authorities had asked the villagers to stop as the side of the mountain appeared increasingly unstable.

Than said he had not seen or heard of the single large find that fuelled the excitement. He described it as “just rumours” and said it was common from year to year for villagers to come en masse on the back of hearsay.

Ek Saro, Rovieng district chief, said villagers often dug in the area during their free time. “Some find a little gold, some are not lucky, but they continue as it is their tradition,” he said.

Pursat village chief sold land illegally, say police

District police in Pursat’s Veal Veng district have accused a village chief of selling 2 hectares of state-owned forest land to three men from Battambang province, who then proceeded to clear the land of all the trees.

The accused, Ouk Bunthoeun, chief of Smert village, who allegedly sold the land to the three men claiming that he owned it, will now be charged with fraud and initiating the clearing of forest land by district police.

An official complaint has been forwarded to the provincial court for further action.

The police say that they were checking for illegal land clearings in the forest yesterday afternoon when they chanced upon the three men, who were in the process of clearing the 2-hectare plot.

The trio – Kem Bros, 26; Sal Saruon, 20; and Tive Bunheng, 45 – were found in possession of three chainsaws, a communication radio and an air rifle, they said.

“They bought the land for $200 to $500 per hectare from Ouk Bunthoeun, who told them that the land belonged to him,” said Veal Veng district police chief Theang Leng.

According to Leng, while the village chief will face legal action, the three men who bought the land were released after they were “educated” about their wrongdoing and signed documents promising to give back the land.

It is no revelation that Cambodia lags behind some of its Asian peers when it comes to affordable and fast Internet access, and that a gap between consumption and infrastructure can lead to a loss of GDP growth.

Though issues remain in establishing the speed and capabilities of the Kingdom’s data network, the public and private sectors have worked to improve connectivity while reducing the price for end-users in a bid to meet the explosion in demand.

Fresh from announcing the construction of the country’s third submarine communications cable to be built by Cambodia Fiber Optic Cable Network (CFOCN) that will tap into the existing AAE-1 cable, one of the main high-speed data conduits linking Asian, African and European countries together, Cambodia’s Ministry of Post and Telecommunication (MPT) is focusing on narrowing the digital divide that separates the Kingdom from developed countries such as Singapore.

By tapping into regional and international data pipelines, Cambodia is aiming to improve its current bandwidth limitations that have caused a comparatively high price for megabytes per second (MBps). Currently, local internet service providers (ISPs) have to purchase Internet bandwidth from the ‘middlemen’ – which in this case primarily come from Vietnam, Thailand and Laos – before reaching the main Internet hub in Hong Kong and Japan.

As the Ministry of Education, Youth and Sports began its annual general meeting this week, NGOs urged the government to prioritise teacher qualifications in a bid to improve the Kingdom’s ailing education system.

On the first day of the three-day meeting yesterday, the ministry laid out 15 areas – ranging from budget management to teacher training, early education and curriculum – that had been targeted for reform.

Chin Chanveasna, executive director of NGO Education Partnership, yesterday said that while all reforms were important, there was a need to prioritise specific reforms to be tackled first.

“I think the teachers’ qualifications – quality of teaching – needs to be prioritised,” he said. “In general, there’s low quality of teaching. We need to strengthen the quality.”

The ministry has flagged revamping teacher training and helping teachers with ongoing studies, with the goal of having all teachers possess bachelor’s degrees by 2020.

Improving teacher qualifications would be a good reform, said Erika Boak, chief of education for UNICEF Cambodia.

“It will take some time for all teachers to have that level of qualification, but it’s really needed,” she said.

In 2012, during the early days of Myanmar’s transition to democracy, U Gambira sat in the front row of a crowded hall at Yangon University and listened while U.S. President Barack Obama delivered an historic speech.

It was a significant moment, both for Myanmar and Gambira. Five years before, as a monk, he had led nationwide protests as part of the“Saffron Revolution,” in which thousands took to the streets calling for an end to direct military rule. In the crackdown that followed he and many of his peers were imprisoned and brutally tortured.

It was remarkable that Gambira should be allowed to attend Obama’s speech, as he had been pardoned and released just months prior. His presence seemed emblematic of the fact that deep change had come to Myanmar, part of a foreign policy success story that many in Washington were eager to claim.

During his address, Obama spoke approvingly on the progress made under new President Thein Sein, noting how, post-Saffron, “the desire for change has been met by an agenda for reform” and, referring to recent amnesties, looked forward to a “future where a single prisoner of conscience is one too many.”

That night, Gambira would pose solemnly for a photograph with a beaming American president; within weeks he would be arrested again.

Vietnamese blogger Nguyen Huu Vinh, is better known as Anh Ba Sam, was sentenced to five years in prison on March 23 for posts on his Ba Sam blog site that were critical of the government.  The former police officer was convicted on a charge of abusing democratic freedoms to infringe on the interests of the state under Article 258 of Vietnam’s penal code. His assistant Nguyen Thi Minh Thuy was given three years in prison on the same charge. Mac Lam of RFA’s Vietnamese Service interviewed the blogger’s wife, Le Thi Minh Ha, on her experience with her husband’s case.


RFA: Before the trial, a German member of parliament, Mr. Martin Patzelt, had flown to Hanoi to support Ba Sam, hoping that he would be allowed to attend the trial. Do you think that what Mr. Patzelt did made the Vietnamese government hand out a harsher sentence to prove that they are not under any pressure?

Le Thi Minh Ha: I don’t think so. The sentence is not dependent on this. They did not base it on any legal ground. I think they had always wanted to reach a compromise with him (Ba Sam), knowing that he may or may not give in. There is no basis for the sentence, there is no evidence, no legal document to base it on. Their action is that of a government that has no law. Why would I have any hope in them? I heard news that the decree of the sentence depended on his attitude. … As for my campaign, since his arrest, I have never had any optimistic expectation of this trial. They violated the law when they arrested him. It was totally wrong. How would I put any hope in this trial? I didn’t expect any solution via this trial. They had to bring him to court to show that they did have some progress. I had no hope, no expectation in this trial. The trial’s result does not affect my thoughts.

RFA: Not many people were allowed to attend the trial.  You and Minh Thuy’s mother were allowed to attend the trial. Can you please let us know what happened inside the courtroom?
